    By virtue of a Dedimus Polestatum to me directed I have proceeded this 8th Day of October to take the deposition of Ebenezer B. Ayers at my house in Peble County and State of Ohio between the hours of nine oclock AM and 3 oclock PM (the adverse party having had legal notice thereof) to be read in evidence in a certain Suit depending and under termina in Athens Common Pleas wherein John B. Ayers is Plantiff and Silas Prudden Defendant

    This deponent being of lawful age and duly sworn deposeth and saith that sometime between the 5th and 10th Days of November AD 1810 that he called on Silas Prudden at his home near the town of Athens & Athens County Ohio & then and there presented unto said Silas Prudden a certain note Signed by Silas Prudden & Bethuel Prudden in favour of Joseph Prudden & dated 1799 the month and day not recollected the amount of said note $43.00 and he thinks 75 cents payable in one year after Date and assigned on the back to John B Ayers by Stephen A Prudden & Joseph Prudden Executors of the Estate of Joseph Prudden Deceased & that he the Said Ebenezer B. Ayers on presenting the above note asked the Said Silas Prudden if he could pay it off then Stating that John B. Ayers had sent it by him for collection that Said Silas Prudden did not answer him immediately but on questioning him the second time he said he could not pay it then nor never would if he could help it but acknowledged that he and his brother gave the note for a pair of Oxen for their father to move into Pennsylvania with

    And further this Deportent Saith not

Hawkins Clerk of the Court of Common Pleas in and for said County do hereby Cerify that David Wiliamson Esq before whom the written Deposition appears to have been taken is one of the Justices assigned to Keep the Peace in and for said County and that Full Faith and Credit is due to all his official acts as Such —
