Bond & Security between DAVID WELSH,JOSHUA WELCH,JOHN WELSH, WILLIAM WELSH,JOHN BARBEE and
JAMES SLAUGHTER are held and firmly bound unto JOHN WITHERS of Stafford Co.,VA, Planters,
for 723 pounds whereas THOMAS WELSH late of Prince William County, Planter, dec'd was seized
of a tract in Prince William now Fauquier had contracted with THOMAS WITHERS, brother of
John Withers to whom it hath been since conveyed by DAVID WELSH, the oldest son and heir at
law of Thomas Welch.
Thomas Welsh by his will dated 13 April 1752, did devise his land as follows: "Item 1 - I give
unto my six sons the land I now live upon until my son BENJAMIN WELSH comes to age of 20 and
then the whole tract to be sold and the money equally divided amongst all my sons as is then
alive.
Said will is duly recorded in Prince William County and whereas the aforesaid David, Joshua,
John and William Welsh, the four eldest sons (his two youngest sons Daniel and Benjamin who
enlisted in the Virginia Regiment being absent) did expose to public sale the remaining part
of said tract containing 664 acres.
JOHN WITHERS was the highest bidder at 361 pounds 10 shillings but it was doubted whether or
not BENJAMIN WELSH was 20 years old and whether 664 acres was the exact acreage of the tract.
JOHN WITHERS demanded a good title, the above gave security that they will do so, and also
refund any balance if the survey proves the tract to be less than 664 acres.
