The condition of the abouewritten obligation is such, that wheras Mary Rogers, of Eastham, widdow, hath obtained of this Court lres of adminnestration to adminnester on the estate of James Rogers, of Eastham, aforsaid, late deceased, if therfor, the said Mary Rogers, widdow, the relict of the said James Rogers, shall and due pay all such debts and legacyes as are due and owing to any from the said estate, soe farr and by equall prortion as the said estate will amount vnto, and dispose of the remainder therof according to order of Court in that case prouided respecting the same, and keep a faire accoumpt of her said adminnestration, and saue and keep harmles and vndamnified the said Gou and Court from any damage that may acrew vnto them by her said adminnestration, that then the next aboue written obligation to be void and of non effect, or otherwise to remaine in full force & vertue." Israel Cole ... son of Daniel and Ruth (?Collier) Cole. ... Settlement of the estate of James Rogers of Eastham, deceased, at Plymouth on 6 May 1678 provided for widow Mary Rogers and her small children, with the eldest, Samuel ... to have a double portion, and the rest ot have equal parts according to the will of their grandfather. Mary, the wife of Israel Cole, was mentioned in the 1705 will of her father Thomas Paine. Israel Cole was said to have been the wealthiest man in Eastham at his death, and his funeral was reported in both the New England Courant and the Boston News Letter. The will of Israel Cole of Barnstable, dated 20 Jan. 1723/4 and proved 23 July 1724, mentioned son Israel (executor) and four grandchildren: Israel, Theodor, Iacobod and Samuel Higgins."
