Tobias, & Wampapaum, and Mattushamama, for that being acused, that they did with joynt consent, vpon the 29 of January, anno 1674, att a place called Assowamsett Pond, wilfully and of sett purpose, and of mallice fore thought, and by force and armes, murder John Sassamon, an other Indian, by laying violent hands on him and striking him, or twisting his necke, vntill hee was dead; and to hide and conceale this theire said murder, att the time and place aforsaid, did cast his dead body through a hole of the iyce into the said pond. These, being examined, deneyed the fact, and put themselues on tryall by God and the countrey, and were found guilty. The Verdict of the Jury giuen into the Court in the words followinge. Wee, of the jury, one and all, both English and Indians, doe joyntly and with one consent agree vpon a verdict: that Tobias, and his son Wampapaquan, and Mattashunnamo, the Indians, whoe are the prisoners, are guilty of the blood of John Sassamon, and were the murderers of him, according to ths bill of inditement. The verdict of the jury being accepted by the Court, the sentance of death was pronounced against them, the said Tobias, and Wampapaquan his son, Mattashanamo, vizt: to be carryed from the place of tryall to the prison from whence they came, and from thence to the place of execution, and there to be hanged by the head vntill theire bodies are dead; and accordingly was executed, the 8th of June, 1675, on the said Tobias and Mattashunannamo; but the said Wampapaquan, on some considerations, was repriued vntill a month be expired from this psent date; But afterwards shott to death within the said month. The Names of the Jury that went on this Tryall. ... Benjamine Higgins. It was judged very expedient by the Court, that together with this English jury aboue named, some of the most indifferentest, grauest, and sage Indians should be admitted to be with the said jury, and to healp to consult and aduice with, of, and concerning the premises. There names are as followeth, vizt: one called by and Enlish name, Hope, and Maskippague, Wannoo, Gorge, Wampye, and Acanootus; these fully concurred with the aboue written jury in their verdict." That he was a soldier in the contest is probable in general, and is proved by his inventory, which shows that he possessed the equipment of a trooper, and by the grant to his grandson, Jedidiah Higgins, of a share in Narragansett Township No. 7, now the town of Gorham, Me. These grants were made only to the direct heirs or descendants of men who had served in King Philip's War. ... It is recorded in the ancient town book of Eastham that on July 14, 1664, 'Benjamin Higgins hath a mare of a brownish bay color and one white foot, the other three feet partly white, with a white strip on her face, and running broad toward the right nostril, a piece cut out of the top side the near ear, and burn marked with E on the near shoulder.' He also had at this time three mare colts. ... Sept. 6, 1686, he was chosen juryman for actions at the County Court at Barnstable. June 4, 1688, he was chosen one of the selectman at Eastham, and again June 3, 1690. 'Aug. 26, 1689, The town have chosen Thomas Paine senior, Daniel Doane and Benjamin Higgins for grand-jurie men for the remainder of this present year.' He was one of the witnesses of the will of John Young of Eastham in 1688 and one of the appraisers of the estate, Feb. 3, 1690-1. The book of land grants of Eastham contains several records of grants of land to him by the town, as follows: 'Richard Higgins sells land to his son Benjamin, 4th day of the 5th month, 1669', 'Richard Higgins sale of land to Benjamin, proving that Richard went to New Jersey, dated at new pascataway in New Jarsey, Nov. 24, 1672.' Mrs. Mary Higgins gave her consent to this and other sales. 'Land granted to Benjamin Higgins Feb. 4, 1673', 'April 16, 1678. Granted to Benjamin Higgins a parcel of medow at the Harbour's mouth.', 'March 14, 1690. Land granted to Benjamin Higgins (near) 'his other land upon poche at a place called bishops butter hole''. An inventory of the estate of Benjamin Higgins, amounting to £85 in real estate and £206.06.00 in personal estate, was rendered June 19, 1691, and sworn to by Mrs. Lydia Higgins, administratrix, five days later. 'Memorandum: that Ichabod Higgins hath already had £10 and a piece of land on which his house stood, appraised at £9.' An agreement was made that Ichabod should have in cattle, bedding, boards, shingles and cash £20.05.00; Richard the loom and gears, 7 acres of land, a cutlass, cartridge box, cattle and cash £20.18.00; Joshua a gun, rapier, cartridge box, bedding, wearing clothes, powder and bullets, saddle and cloth, cattle, sheep and cash £20.05.00; Lydia should have cattle, sheep, an iron pot, books, cloth and cash £20; Isaac a gun, ammunition, a cutlass, cartridgebox, bedding, clothing, cattle, sheep and cash £20.05.00; Samuel was to have a gun, sword, cartridgebox, a book, bedding, clothes, ammunition, cattle, sheep and cash £20.05.00; Benjamin was to have two-thirds of the housing and one-third of the lands and meadows; the widow to have her legal third part. She was living Feb. 13, 1706-7, when her brother, Joshua Bangs, willed to her one-eighth part of such personal estate of his as might remain after the death of his wife. Aug. 20, 1711, town of Eastham 'laid out to widdow Lidia Higgins for her natural life and then returns to the town, a parcel of land near the head of Namskaket on the Eastern side of the first lot which is the lot of Daniel Cole Sr.' The date of her death is unknown. Jesse was a private in the French and Indian War, being in the 6th co., Capt. Gaylord's, of the First regt., commanded by Col. Phineas Lyman. Dates of service: April 1, 1758, to Sept. 19, 1758; Sept. 19 to Nov. 21, 1758; March 24 to Dec. 16, 1759. He was private in the 8th co. in the Lexington Alarm, April 17, 1775; also in Second regt., Gen. Spencer's, May 11 to December, 1775; enlisted March 17, 1778, in Judd's co. The last two enlistments may belong to Jesse, son of Lemuel Higgins. There is no means of deciding, but they probably belong to this Jesse Higgins, who closed his life while still in the service of his country, at Fishkill-on-Hudson. He was absent from home, serving in the army and perhaps at sea, for long periods. He appears to have held a small parcel of land in the parish of Middle Haddam, where he lived when not serving elsewhere. His first marriage was unhappy and there were no children. His wife Ruth obtained a legal separation from him in January, 1772, and he immediately married again. Mrs. Keziah Higgins was appointed administratrix on his very small estate in 1780 ..."

He was not in the 29 May 1670 list of Plymouth freemen ... died within a few years of his arrival in New Jersey, and no will has survived, but his widow is called executrix of his estate [PCLR 5:139]. The widow acquired much land in the period after Richard's death ... DEATH: Piscataway after 20 November 1674 [PCLR 4:165] and before 1 June 1675 [PCR 5:169-70]. MARRIAGE: (1) Plymouth 11 December 1634 Lydia Chandler (Eastham records give this date as 23 November, but the Plymouth record is clearly to be preferred), probably daughter of EDMUND CHANDLER; she died probably shortly after the birth of Benjamin in 1640, and certainly before Richard Higgins remarried. (2) Eastham October 1651 Mary (___) Yates, widow of John Yates of Eastham [MD 8:13]; she survived her second husband and married (3) at Piscataway as his second wife Isaac Whitehead, she having recanted her intention to marry Samuel Moore Sr. of Woodbridge [NYGBR 47:21]. She was living in 1702 when her son Thomas allowed her a life tenancy in part of his home [NYGBR 47:22] ... ASSOCIATIONS: The contention that the first wife of Richard Higgins was daughter of EDMUND CHANDLER is based in part on the frequent early interactions of Higgins with Chandler and his son Samuel. Richard Higgins was with Edmund Chandler creditor of estate of Godbert Godbertson, 1633 [MD 1:157]; with Samuel Chandler, creditor of estate of John Thorpe, 1633 [MD 1:160], and surety for Samuel Chandler in court case of 3 December 1639 [PCR 1:137-38]. In 1639 John Smalley took over from Richard Higgins the apprenticeship of Samuel Godbertson (both men were tailors) [PCR 1:129-30]. The association between Smalley and Higgins continued in 1640 with an exchange of Plymouth land [PCR 12:59]. Higgins and Smalley migrated about the same time to Piscataway, and continued together in land transactions there. COMMENTS: Two hypotheses have been set forth on the English origin of Richard Higgins. Orra E. Monnette published one, which was based on family papers, as verified by Gustave Anjou. This proposal was refuted in 1918 and 1924 by Katharine Chapin Higgins, and the ever-gullible Monnette was clearly taken in by the ever-mendacious Anjou. The alternate suggested origin, that the immigrant was the Richard Higgins who was apprenticed as a tailor in 1627, is at least possible and has some attractions, but is far from being proved. The claim that Higgins came in 1623 cannot be true, since he did not participate in any of the land grants made to this group of immigrants. The claim that he came in 1629 on the Talbot is not impossible, but is not supported by any documentary evidence ... A son William is recorded in Plymouth vital records as born 15 December 1654, an impossible date given the birthdate for Eliakim; this William is not seen again, and is probably an erroneous entry. Rebecca is called daughter of Richard and Mary in her marriage record in 1683, given this date of marriage she must have been born in Eastham, even though there is no record of her birth there. The last two children, Ruth and Sarah, were presumably born after the move to Piscataway, they are included as children of Richard and Mary since they have the surname Higgins in their marriage records, and Thomas Higgins is co-administrator with Ruth on the estate of her first husband. ..."

The boat became unseaworthy and was forced to put back. Some time later he came here again, landing at Plymouth, then moving to Eastham in Massachusetts. His final settlement was in Piscataway, N.J. where he had 254 acres of land, and where he spent his last remaining years. There was vigor, strength, and energy in his life. He was one of first five who founded Eastham, acting as Selectman of the Town seven times. ... From 1647 to 1651 Richard was a Representative of the Colonial Assembly, by summons from the General Court concerning confederation of the United Colonies. ... Among the overseers of The Poor, appointed by Eastham according to Colonial records, was Richard in 1658. He was one of those who agreed with the Town that year to furnish men and equipment for the 'Troop of Horse' ... A bronze tablet was erected to the memory of Richard Higgins on Aug. 26, 1916. Lieut. Calvin Coolidge, later President of the U.S., representing the Commonwealth of Mass., paid tribute to Richard Higgins' name. The inscription on the tablet read: 'TO THE MEMORY OF RICHARD HIGGINS' 'One of the Founders of the Town and church of Eastham, Mass., then called Nauset. Juror and Selectman of the Town. Elected Deputy of the General Court of Plymouth from 1633 to 1644. A resident of Eastham from 1644 to 1669. He died before 1675. Through five sons and three daughters he became the forefather of the Higgins Family on these shores, and in New Jersey where he was a planter at Piscataway in 1669, Maine and Conn. Many descendants are scattered abroad this country...courageous, respected, trusted, and honored.'"

" ... married (1) (by Rev. Samuel Treat) Nov. 4, 1703, Hannah Cole, born June 28, 1681; died Feb. 25, 1716-7; daughter of Israel and Mary (Paine) (Rogers) Cole and great-great-granddaughter of Stephen Hopkins of the Mayflower, 1620 ... Samuel Higgins resided at Eastham and was probably a farmer. He was one of the witnesses of the will of Nathaniel Mayo, Aug. 10, 1715, and gave testimony for the same July 9, 1717. He was elected tithingman Jan. 10, 1727-8, and constable on March 10, 1728-9. March 10, 1730-1, he was chosen surveyor of highways and again March 4, 1733-4. These are all the town offices he is known to have filled. In 1703 land was granted to him on the town flats, but he doubtless possessed other land in Eastham. His four sons, Israel, Theodore, Ichabod and Samuel, all were given lands by the will of their grandfather, Israel Cole, of Barnstable. The three older sons all removed to Connecticut. Samuel died before his father. Only the sons of the second wife remained in Eastham, and one of these may have removed ..."

"Samuel Higgins, the father of our subject, is numbered among the pioneers of Eaton County, he having been the first to settle in the northern part of Bellevue Township. He was born in Middle Haddam, Conn., and was a shoemaker by trade, and also carried on a farm in Franklin County, Mass. He removed from that place to North Adams, where he worked in a calico factory until 1836, when he came hither. He bought sixty acres of Government land, which is part of the present estate of his son Sylvester, and taking up residence in a log house, followed farming until a short time before his death. He then lived retired in Marshall, but died at Battle Creek while on a visit there. He was then seventy-five years old. During the Revolution he went out to defend Boston Harbor. He was an Elder in the Presbyterian Church, and was an upright and earnest Christian. his wife, formerly Elizabeth Nims, was born in Shelburne, Mass., and died in Bellevue when sixty-eight years old."

In the Congregational Church Records: "The three years, 1819, '20, & 21, were perhaps unprecedented in the coldness and stupidity of the church; very few professed their faith in Christ, and they either had indulged hope in the mercy of Christ for some time, or had obtained hope in other places. Many felt that temporal things had obtained strong hold of many hearts; earthly vanities were eagerly sought and exerted an unequaled influence over the young; and religion seemed to have lost its power. Yet, during this season, the light of the church was not wholly extinct. A few sustained the established prayer meeting, and manifested a spirit of devotion and faith seldom witnessed. Messrs. S. Thompson, S. Allen, J. Nims, W. Buck, J. Chapin, S. Higgins, S. Hastings, A. Thayer, E. Gould were of this number. Several ladies also sustained female prayer meetings; and some were agreed to pray for their unconverted husbands, till the Lord should have mercy on them."
