These cases came on this day to be heard together; the first on the papers formerly read, and the report of the Commissioner made pursuant to the order of the eighth of January, 1824, the second on the bill, the answers of the defendants Horatio Gates Winston, Nicholas I. Poindexter and John Guerrant, guardian ad litem to the infant defendants, William, James and Elizabeth Mereweather; as to the defendants Andrew Keen, Edmund Pendleton, Jr. John Taylor and William Pollard, on the several decretal orders, taking the bill for confessed against them, which appear to have been duly executed; and as to all the other defendants, by publication in the mode prescribed by law against absent defendants, and exhibits, and were argued by counsel: On consideration whereof, it being admitted that the defendants, the representatives of David Mereweather, dec. have surrendered their claim to the subject in controversy, to the plaintiff in the second suit, Ann Winston-
and the court being of opinion that the claim set up by the said David Mereweather and his brother William Mereweather, to a part of the subject in controversy, under a purchase alleged by them to have been made in the year 1798, cannot be sustained, doth adjudge, order and decree, that the said claim be disallowed; that the property in controversy be disposed of by the plaintiff in the first suit, Horatio Gates Winston, adm'or de bonis non of James Mereweather, dec. as the property of his testor's estate, first for the payment of his debts, and next for the satisfaction of legacies; and to that end, that the said administrator, retaining one of the slaves for the satisfaction of the specific legacy to the said Ann Winston, do proceed to sell the residue thereof for cash, such sales not being objected to by the parties, and deposit the proceeds of the sales, in one of the banks in this city, to the credit of those causes subject to the future order of the Court-and the Court!
doth re-commit the said report to the Commissioner who made it, for the purpose of bringing down the account of administration of the said Horatio Gates Winston, to the time of making his next report, and for the further purpose of taking an account of the several debts due from the estate of the said James Mereweather, dec. to any of the parties in these suits, or others after the notice for that purpose, published in one of the newspapers printed in the city of Richmond, for eight weeks successively-and the said commissioner is required to state and report to the Court, an account of the surplus of the assets, after the payment of debts, and the amount to which each party will be entitled, in the application of that surplus, to the purposes of the said James Mereweather's will, together with any other matters specially stated, deemed pertinent by himself, or which may be required by the parties to be so stated.

These causes came on this day to be further heard on the papers formerly read; the report of the Commissioner pursuant to the interlocutory order of the tenth day of March, 1829, with the exceptions thereto, and the report of the plaintiff in the first suit of the sales made by him, pursuant to the same order were argued by Counsel. On consideration whereof, the Court approving the last mentioned report, to which there was no objection, doth direct the said plaintiff to return the bond of Mrs. Ann Winston mentioned in his said report, in his possession until the further order of the Court; and the Court doth recommit the report of the Commissioner with the exceptions thereto, to the same Commissioner, for him to consider the report thereupon, with any matters specially stated, deemed pertinent by himself, of which may be required by the parties to be so stated.
