James H. Meriweather, Deceased

It appearing to the Probate Court that on the 28th day of December AD 1846 the last will and testament and codicil thereto of James H. Meriweather, decd. was duly admitted to Probate and record in the Court of Common Pleas of Hamilton County, Ohio, and the record of said will and Codicil was after_____ by law transferred to the Probate Court of said County, and that the original Record of said Will and Codicil and the Probate thereof upon the record and journal of said court were destroyed in the burning of the Court House on March 29th AD 1884, but that the original will and the codicil and the testimony of the witnesses thereto were presented.  It is now ordered by the Probate Court on its motion, that the records of said will and codicil and the probate thereof and the same is hereby restored by same original will and codicil and testimony as provided by Statute and in the words and figures following to wit:

I, James H. Meriweather of Mount Auburn, County of Hamilton, State of Ohio, being of sound mind and understanding (blessed be almighty God for the same)  and knowing the certainty of death, and the uncertainty of the time thereof, do make and publish this my last will and testament, in manner and form following that is to say

I request that all my debts & funeral expenses be paid.

To my beloved wife Louisa I give and bequeath all my furniture and other personal property of whatsoever kind in Mount Auburn which I may own at the time of my decease; and also all my share, stock, interest and claim in and to the firm of JH & N Meriweather and all my title thereto and in the debts due or to become due said firm, and also all my rights, credits, goods, chattels and personal estate whatsoever forever subject nevertheless to the payment of the bequest hereinafter contained.

I give and bequeath to my executor and executrix hereinafter named or the survivor of them my house and lot in Mount Auburn to be sold at their discretion and upon such sale good and sufficient deeds therefor to make and deliver in the same manner I myself could do if in life; and upon such sale to pay to my wife the one half of the purchase money to her forever, and the other half to be by them or the survivor of them deposited in the Ohio Life Insurance and Trust Company at interest until my nephew James Meriwether Griffith arrives at the age of twenty one years when they or the survivor of them shall pay my said nephew said half of said purchase money with the accruing interest to him my said nephew James M. Griffith forever, and in case of his death without lawful issue then to my brothers John H. Reuben, and William.

To my brother William I give and bequeath the sum of one thousand dollars to be paid him as soon as the sale can be realized and out of the apts of said firm of J H & N Meriweather my gold watch and breast pin I give to my said nephew James M. Griffith.

Lastly I nominate and appoint my friend G.R. Chisdine executor and my said wife Louisa executrix of this my last will and testament, hereby revoking all former wills and dictating this my last. In witness whereof I have hereto set my name & affixed my seal this ninth day of December in the year of our Lord eighteen hundred and forty six. Codicil to the foregoing will, I James H. Meriweather do make and publish this Codicil to the foregoing will. To my said brother William I give my gold watch and the bequest of the same to my said nephew James M. Griffith is hereby revoked. The _____ interest of the share of the ______ of the ____ of my Mount Auburn property by _____ to my said nephew which I bequeathed to my brother John H., Ruben & William, I hereby give and bequeath to my brothers Nicholas, John H. Ruben and William each to share and share alike in much in the case of the death of my said nephew without lawful issue and so much of said will as conflicts with this bequest is hereby revoked. In witness whereof I have hereto subscribed my name and affixed my seal at Mr. Auburn this fourteenth day of December in the year of our Lord one thousand eight hundred and forty six.
