I Thomas Merriwether of the state & county aforesaid being of sound mind and memory, do make and ordain this to be my last will and Testament.

I give to my son David Merriwether and my daughters Ann Jordan, and Mary Reese, the tract of land on which I now live, my negroes Milly, Clem, Charles and judy, and all other property that I may die possessed of, to be equally divided among them.

I appoint my son-in-law Fleming Jordan, and David A. Reese and my son David Merriwether my Executors to this my last will & testament.

In witness whereof, I have hereunto set my hand and seal this fifth day of February in the year of our Lord, one thousand eight hundred and thirty one

 Personally appeared in open Court Luburn (sic) Mosley one of the subscribing witnesses to the within will who being duly sworn deposeth that he saw Thomas Merriwether sign, seal, publish, and declare, the within to be his last will and testament, and that he was of a sound disposing mind and memory, at the time of the signing thereof, and that himself together with Riley Finley & Jesse Chat (sic) subscribed the same as witnesses in presence of the testator

(Notes: the last year is definitely 1843 and not 1834. Merriwether definitely has 2 r=s in it. ALaburn@ is spelt once with a Au@ and twice with an Aa@. Likewise, Chatt has 1 At@ in one case and 2 t=s in the other.)
