EXTRACT FROM THE WILL OF

GRACE HAIGH (FORMERLY SUTCLIFFE, NEE BARKER)

OF GAUXHOLME, INN KEEPER

 

Taken from Abstract of Title document dated 1849

Died 20 September 1817

 

Probate of the will of the said GRACE HAIGH, whereby after willing, ordering and directing that all her just debts, funeral and testamentary expenses should be all paid and discharged, and of her whole substance or estate, gave unto her three sons, John, James and Henry (whom she has appointed her trustees and executors).

All that her messuage or building situate at a certain place called Butcher Hill in the Township of Todmorden and Walsden, then occupied in 5 cottages or dwellinghouses  and in the several tenures or occupations of her son JAMES SUTCLIFFE, THOMAS THEW, JOHN CRABTREE, Wm. WHITTAKER and Abm. BARKER, or some of them.

In trust nevs. That they, her said trustees and exors. or the survivors or survivor of them, or their heirs, exors.,  or admors., of each survivor, should & did let & set the same, yearly for as much rent as he or she or they, could obtain for them, & pay & apply such rents towards the maintenance & support of her son Thomas during his natural life & at his decease.

Upon further trust, to sell the same premises as soon as convenient after, & the money arising from such sale, she gave equally unto and amongst her five children viz., John, Sally, William, James and Henry, & in case any of them were then dead & had left lawful issue behind him or her, then she gave the share of him, her or them, being so dead, equally unto & amongst such issue (if more than one), & all to one in case of no more, & to be paid to him, her or them, when & as he, her or them attained to the age or ages of 21 years.

To her six grandchildren viz., John, Sally, Betty, James, Grace & Hannah, sons and daughters of her daughter Mary, deceased, wife of JONAS TURNER, Blackshawhead, she gave each the sum of £20 to be paid to them when the youngest of them should have attained the age of 21 years or sooner, at the discretion of her said trustees & executors.

All the rest residue & remainder of her property whatsoever & wheresoever she gave & bequeathed equally unto & amongst her five children, namely John, William, James, Henry & Sally, to be paid to them at the end of 6 months next after her decease.

Duly executed & attested by two witnesses & proved in the Exchequer & prerogative court of York on the 8th May 1818 by said JAMES SUTCLIFFE & HENRY SUTCLIFFE.

The vendors must make a statutory declaration that the debts  & legacies are paid, & produce legacy receipts.

Also that Thomas and John are dead & when and where buried –Thomas died 13 July 1849.

John’s will must be produced-produced

Are Sally & William still living- if not, what are the names of their respective children & are they of age-& did Wm. …. Widow-yes-her name is Susan.

Are these legacies paid.
