JOHN FIELDEN

yeoman of Bottomley in Walsden

This is the last will and testament of me John Fielden of Bottomley in Walsden in the Parish of Rochdale and County of Lancaster, yeoman, as follows.

 

First I will that all my just debts, funeral expenses and the incidental expenses upon the probate and execution of this my last will be all only paid and discharged, and I do give bequeath and devise all the rest and remainder of my estate and effects both real and personal of every denomination whatsoever unto my trusty friends, Barnes Fielden of that part of Todmorden lying in the County of York, shop keeper, and James Scholfield of that part of Todmorden lying in the County of Lancaster, joiner, to hold to them and the survivor of them in Trust always that they or the survivor of them or the heirs, executors or administrators of the survivor of them do and shall sell and convert all and every part thereof into money as soon after my death as convenience will admit for the best price that can be fairly obtained for the same, and that their receipt for the purchase money shall be agreed and discharged to the purchaser for the same.

 

And that they do and shall pay out of the money raised all my just debts, funeral and all other necessary expenses and then divide the remainder of the money in equal shares amongst and between my children, namely: John, Mally, Betty, Hannah, Sally and Martha, share and share alike.

 

And I nominate and appoint them the said Barnes Fielden and James Scholfield joint executors of this my last will and testament, revoking and making void all former wills by me made. And that they shall not be answerable for the acts or neglects of one another, but each one for his own acts and neglects.

 

In witness whereof I put my hand and seal this twenty eighth day of February in the Year of Our Lord one thousand eight hundred and twenty two.
