IN
THE NAME OF GOD AMEN I Samuel Law of Smales in the
township of Todmorden and Walsden in the Parish of Rochdale in the
County Palatine of Lancaster, Yeoman, being of sound and disposing
mind and understanding, whereby I do will, order and direct that
all my just debts and funeral expenses and the charges of this my
will in probate, shall be all first paid and discharged out of my
whole substance or estate together with all the reasonable wages
and expenses of my executors herein after named and appointed in
and about the execution of this my will.
I
do also will and direct that my executors herein after named and
appointed shall dispose of my household furniture wheresoever the
same maybe found either by way of auction or in any other way they
may think proper and pay and apply the product in manner following,
that is to say:
First:
I
give and devise to my sons William and John all my estate, messuage
and dwellings called Smales, situate in the Township of Todmorden
and Walsden in two equal moieties and I do hereby order and direct
my two sons to ascertain the value of the property either by private
contract or any other way they may think most convenient within
the space of 12 months after my decease. And if my two sons cannot
agree about the value of the property then my son William shall
pay to my son John the sum of eighty pounds and the dwelling house
I now live and then enjoy the remainder of the property himself.
Then:
I
give and bequeath to my daughter Susan the wife of William Crowther
the sum of sixty pounds. I also give and bequeath to my daughter
Betty the wife of Thomas Greenbank the sum of sixty pounds. I also
give and bequeath to my daughter Sarah the wife of James Dawson
the sum of sixty pounds. All these three sums to be paid at the
end of 12 months next after my decease. All the rest, residue and
remainder of my property of whatever nature or kind I give and bequeath
to my two sons William and John in two equal shares, share and share
alike.
Lastly:
I
do hereby revoke and make void all other wills by me already made
and do now declare this present writing to contain my last will
and testament and do hereby constitute, nominate and appoint my
two sons William and John joint executors hoping they will faithfully
execute the trust I have in them. Given under my hand and seal this
seventeenth day of February 1840.
