Henry Martin will, Washington Co., Jonesborough, TN In the name of God Amen, I HENRY MARTIN of the county of Washington in the state of Tennessee being weak in body but sound in mind and memory and calling to mind the mortality of my body knowing that it is appointed for all men once to die. I do make ordain constitute and appoint the following and none other to be my last Will and Testament.
Primarily and first of all I commit any soul into the hands of God who gave it and my body to the Earth to be buryed in a decent and christian like manner it the "diseration" of my Executors.
And as to such worldly Estate wherewith it has pleased God to bless me I do devise ordain and dispose of in the manner and form following that is to say I allow my beloved wife CLOE MARTIN to have and continue in prosession of the land until the youngest child comes of age and then to be sold to the best advantage and the price of it to be equally divided among my wife and all the children and also that she keep in her hands or have at her disposal all the household furniture during her natural life and that my son RICHARD MARTIN have the horse that he "informally" calls his, and that my daugter BETTY JONES is to have one cow and calf "......" of their share of other property. And the balance of the stock together with the farming utensils are all to be exposed to publick sale and the price of them to be equally divided among my wife and all my children each of them an equal share and the shares of those that are under age to be put out on interest untill they come of age and then my Executors to pay such of them their several shares and the interest of their money to be appropriated to the use of schooling those of them who need of schooling- and as to what money there may be now in hand or debts that is coming to the Estate I allow that in the first place all my lawful debts be paid and if there be a surplus let it be equally divided and the same manner as the sale money above mentioned. And it is my will that my friend ABEL WILLY and my son JOHN MARTIN be sole Executors of this my last will and testament After examining the papers we find the Executor John Martin has received assets in his hands amounting to thirteen hundred and sixty-seven dollars and eighty cents and one half one on the 30th October 1821. Including interest, on all notes to that date and find interest in his hands the sum of fifty-two dollars incurred we find debt and expenses and executors commission five hundred and fifty four dollars nine cents and a half leaving a balance in his hands of seven hundred and sixty five dollars and seventy-seven cents and a half from information of the executor there are ten heirs and each heirs part being the sum of seventy six dollars fifty seven cents and a half besides interest ;
(Page 121) Henry Martins Estate Henry and Chloe Boswell Martin came to Washington Co., Tennessee from Maryland and settled on the south end of Washington County as you can tell by the names of people on the receipts ; Joseph Mclin, Joseph Martin, Daniel Barkley. I am most certain that John Martin executor was living in the same area and is the one who married Elizabeth Hartman. The other John Martin who has been associated with our Henry Martin was living in the area toward Carter Co., Tennessee. I have found nothing that connects him to our Henry & Chloe Boswell Martin. Maybe someday I can look for a deed in Washington County CHLOE ANN BOSWELL was born 1767 in Port Tobacco Co., Maryland. CHLOE ANN BOSWELL MARTIN DEAKINS died 28 OCT 1850 in TN The following children were born in Maryland Caleb, John C., Richard B., Elizabeth, and Lucretia
Children born in Tennessee were Ann, Elias, Sarah, and Rebecca Chloe married a second time to James Deakins February 10, 1831 Neighbor to Henry A. Martin (grandson of Henry & Chloe B Martin & son of Caleb & Sally B Martin was Samuel M. Hunt. The Hunt-Martin Family Cemetery is located on the Hunt land which later became the Martin land ; Maden Land and at the present the Fulkerson land and today 2007 borders the Gray Fossil site
