Cutting and carrying away Withies.

John Tilbery and Reuben Pink were charged with wilful damage and carrying away underwood from a row in the parish of Clanfield, the property of Mr. Courtney.

- It appeared from the evidence of John Knight, gamekeeper, that the defendants were in the employ of George Money, landlord of the "Rising Sun" at Clanfield, and that on the 29th of June he discovered the damage complained of, and traced the tracks of two men through a piece of wheat for about 300 yards, to where the defendants were employed cutting up oak-lop into bunts, in the Three-Acres-row. Witness, upon going to them, observed, "I find it is all right," when the defendant Pink said, "You was forced to tell Courtney about they few withies; we had only three-quarters of a hundred and a few over."

- Defendant Tilbery said the withies were sent to them by their master, and called George Tilbery as a witness, whose evidence proved he was not there as the time of delivery.

- William Coles was then called, who deposed to being in the employ of George Money, and to carting 300 withies to the Dutch Acre Coppice.

- [in response to a question] By the Chairman: "I don't know the day, nor the month, but 'twas before breakfast one morning."

- Mr. Courtney said his object was not so much for punishment as for caution, in consequence of considerable damage having been done to the underwood lately. The defendants were ordered to pay the costs, 4s. 9d.; damage, 6d.; and fine, 2s. 6d.

- Mr. Courtney here appealed to the bench, and complained of Thomas Tilbery, the father of one of the defendants, having threatened and abused him in court, upon which the hon. chairman called the offender forward, and after strongly reprimanding him for his conduct, cautioned him not to repeat the offence, or he would be committed to prison, where he would be severely punished.
