This is the Last Will and Testament of me Robert Tilbury of Hastings in the Town of Calcutta Government Pensioner.
I de[sire] that my funeral may be as little expensive as decency will permit.
I give and bequeath to my wife Catherine Tilbury all her wearing apparel and ornaments of her person and all her household goods and furniture except my Books and Piano, for her absolute use and benefit. I also bequeath to my said wife during her life or so long as she remains my widow, in trust all the rents and proceeds of my four houses viz. No. 4/1 a demi-upper-roomed brick built house situated in May Road Hastings, No. 5 a lower-roomed brick built house also situated in May Road, Hastings, No. 2 a lower-roomed brick built house situated in Lenard Road Hastings, and No. 2/1 a lower-roomed brick built house also situated in Leonard Road Hastings, together with the land, premises, and appurtenances attached thereto respectively, and I direct that from such rents and proceeds aforesaid my said Wife shall after paying all taxes and assessments and other charges retain the balance for repairs to the said houses and for her support and maintenance, and for the support and maintenance of my two unmarried daughters, Ella Catherine Tilbury and Emma Frances Tilbury until they are married and the surplus if any to be deposited in the Government Savings Bank, but in case my Wife should at any time after my death again marry all her right title and Interest in the rents and proceeds of the said houses as aforesaid shall thereupon cease, and she shall upon such second marriage immediately appoint one or more Trustee or Trustees to take charge of and administer to my said Estate. In which case I direct that such Trustee or Trustees shall upon recovery of the said four houses lands and premises after payments of all taxes, assessments, and charges as aforesaid, deposit one third of the surplus thereof in the Government Savings Bank; the remaining two thirds to be used in the maintenance and support of my said two daughters as aforesaid until they are married.
I further direct that from such one-third of the said rents and proceeds of the said houses and premises as shall accumulate in the government Savings Bank the said Trustees to be appointed as aforesaid shall from time to time as to them shall seem fit expend such sums of money for absolutely necessary repairs to the said houses and Premises as may be required to keep them in good tenantable condition. I also further direct that in case my said Wife should again become a widow, or be in trouble and distress during the term of such her second marriage, and if the said Trustees or Trustee are satisfied with the justness of the case, then and only in such case they shall be at liberty to allow her and give her monthly and every month the sum of Rupees Thirty from the said accumulated funds in the Government Savings Bank, and at her death whatever surplus may then remain in the Government Savings Bank to be divided in equal shares between my said two daughters Ella Catherine Tilbury, and Emma Frances Tilbury if they are at the time married or have attained the age of twenty one years respectively for their respective use and benefit absolutely.
At the death of my said wife Catherine Tilbury I give and bequeath and dispose of my said houses, with all the land, premises and appurtenances thereto respectively belonging, subject to be charged with the payments of all mortgage debts charged thereon, and also subject to cantonment regulations, the ground being Government Ground in manner following.
To my grandson Robert Samuel Russel Cobb, son of my deceased daughter Ida Annie Cobb for his sole use and benefit, the lower-roomed house and premises, No. 2 Leonard Road, Hastings, standing upon more or less eight cottahs and four feet of Ground, and yielding a monthly rent of Rp 70 / Seventy a month, but in the event of the said Robert Samuel Russel Cobb, being under age, that is under twenty one on the death of my said Wife, Catherine Tilbury, then the house shall be placed under the care of the Trustees, so appointed as aforesaid, who shall first make over monthly and every month to my son Alexander Staercks Tilbury the sum of Rupees Ten only during his natural life, and the balance after deducting for repairs taxes assessments and other charges, to be placed in the Government Savings Bank for his education, clothing and maintenance, but on his attaining the age of twenty one, he shall come in possession of the Estate on condition that he shall make over Monthly and every month the sum of Rupees Ten only to my son Alexander Staercks Tilbury during his natural life, as aforesaid, but in the event of the death of the said Robert Cobb, leaving no children, the house to be m___ over to my said two daughters Ella Catherine and Emma Frances, their or either of their lives. To my daughter Ella Catherine for her sole use and benefit the house and premises __ No. 4/1 May Road, Hastings, containing more or less fourteen Cottahs and eight Chattacks of ground on condition that she shall upon coming into possession of the said property give and pay over monthly and every month to my daughter Eliza Louisa Norris, during the term of her natural life, the sum of Rupees Ten only, and in the event of my said daughter Ella Catherine dying without leaving issue, then I give and bequeath the said House and premises No. 4/1 May Road to my daughter Emma Frances and her heirs on the condition last aforesaid. To my daughter Emma Frances for her sole use and benefit, the house and premises No. 5 May Road, containing more or less fourteen cottahs and eight chittacks of ground on the condition that she also shall upon coming into possession of the said house and premises, give and pay over monthly and every month to my said son Alexander Staercks during the term of his natural life the sum of Rupees Ten only but in the event of my said daughter Emma Frances dying without issue, then I give and bequeath the said House and Premises No. 5 May Road to my daughter Ella Catherine and her heirs on the same condition as aforesaid.
To my wife Catherine Tilbury for her sole use and benefit a lower-roomed brick built house with premises No. 2/1 Leonard Road Hastings containing more or less eight cottahs and four feet of ground but in the event of the death of my said wife Catherine Tilbury to be disposed of as shall be determined hereafter. But in the event of my said wife Catherine Tilbury surviving both my said daughters Ella Catherine and Emma Frances, and in case my said daughters be predeceased without leaving issue then and in such case I direct that the said houses and premises No. 4/1 May Road and No. 5 May Road as also the reversionary interests of my said two daughters in the house and premises No. 2 Leonard Road, be sold and the proceeds of such sale as also all accumulated funds in the Government Savings Bank be equally divided between all or any of my descendants then alive or their heirs absolutely.
I give and bequeath all my Books and Piano to my said two daughters Ella Catherine and Emma Frances, for their joint use and benefit without any reservation.
I hereby appoint my said wife Catherine Tilbury my Executrix also Mr. Alfred John Wilson Executor and Trustee also Mr. Andrew Chamarett Trustee both of the Survey Department, they are to recover all my outstandings, and pay all my lawful debts, funeral and testamentary expenses, and administer to my estates generally, but in case my Wife should marry again, the Trustee or Trustees whom she may appoint as aforesaid to be my Trustees or Trustee for the purpose aforesaid and I declare that if the said Trustees so appointed shall die or be desirous of being discharged or refuse or become incapable to act then and after the said Trustees or Trustee may appoint any other person or persons to be a Trustees or Trustee in the place of the Trustee or Trustees so dying or desiring to be discharged or refusing or becoming incapable to act. And upon every such appointment the said trust premises shall be so transferred that the same may become visited in the new Trustee or Trustees jointly with the surviving or continuing trustee or trustees or solely as the case may require. And every such new Trustee shall have the same powers, authorities and discretion as if he had been hereby originally appointed a Trustee. And I hereby declare that the Trustee or Trustees for the time being shall be chargeable only with such monies as they or he respectively shall actually receive and shall not be answerable the one for the other of them nor for any Banker or [Broker] or other person - in whose hands any of the trust monies shall be placed, nor for the insufficiency of any stocks funds shares or securities, nor otherwise for any involuntary losses. And that the said Trustee or Trustees for the time being may reimburse themselves or himself out of the monies which shall come to their or his hands under the trust aforesaid, all expenses to be incurred in or about the exe[cution] of the aforesaid trusts. In witness whereof I the said Robert Tilbury have to this my last Will set my hand this eighteenth day of January in the year of our Lord one thousand eight hundred and eighty one.
