It should be taken into consideration that Any pup/dog going to a new home "MAY"
be a bit unsure of itself, until it becomes familiar with his/her new family and surroundings.
They will need time, your Love and assurance to adjust. BUYER should NEVER assume
that it is OK to take animal out of safe surroundings without having a secure collar and
leash on pup/dog, animal.
______BUYER understands that, Seller requires a deposit of $100.00 (one hundred dollars)
of purchase price-(Non-refundable-AFTER three (3) DAYS) to reserve and retain/hold the
aforementioned pup for final Sales, that both parties agreed upon for Future transfer date of
this Date__________________, and No more than Five(5) days thereafter this written date
(unless included by Seller in writing), at which time, said dog will be transfered to Buyer
upon Payment In Full. If buyer fails to meet this agreement by specified date,
the final sales/transfer of said dog to this Buyer will be terminated.
I_____________________OWNER/Breeder of this Litter, certify that this dog is eligible
for registration under the Rules/Regulations of the American Kennel Club as a
purebred ("breed" ) and will provide the proper registration form of said dog/bitch,
to be marked Full or Limited by My Initialed handwriting upon the FINAL Completion
of the Sale of this said dog/bitch.
*_______________________BUYER Understands and Agrees that if the Sale of
said dog/bitch is on any other FORMS or TERMS of PAYMENT, AKC Registration
papers will be withheld until the Specified Agreements of this Contract have been met
to the satisfaction of the Seller/Owner/breeder of this above mentioned dog/bitch.
______BUYER agrees--The Breeder reserves the right to affix and retain the kennel name
"Quest Stars" in the sale of said pup according to AKC Rules/Regulations.
____SELLER guarantees This puppy is to be of *SHOW* quality and not have any
Disqualifying faults as stipulated by the AKC standard for said breed. If a Disqualifying fault
develops after the puppy is sold to the buyer, this dog will be deemed Pet quality. When the
Buyer provides proof of the Disqualifying fault and a spay or neuter certificate, the breeder
will refund the difference between pet and show quality or will replace pup as soon as
one becomes available. Quest Stars Kennels will not be responsible for any expenses incurred.
______BUYER agrees It is the Buyers responsibility to take the animal for a complete physical
examination by his/her own veterinarian within 72 hours of taking possession. If the animal is
found to be ill or in poor health within 72 hours of purchase, a report of the results is to
be sent to Quest Stars Kennels and said dog may be returned immediately at No expense to
the breeder, Provided that the dog has not been damaged in any way, the Buyer will then be
entitled to a refund of the original purchase price, pending verification by the breeder's
veterinarian. Quest Stars Kennels will not be responsible for illness or health problems which are
diagnosed after this time period except those conditions specified in this contract.
______BUYER agrees That it is a condition of this agreement that the BUYER is signing a
"SHOW"/Breeder contract and ADHERE to it and that, a Certified OFA or (preliminary OFA
of passing) radiograph, a CLEAR/Von WillieBrands, NORMAL/Thyroid and CERF/(eyes) test
is done before any breeding. If breeding takes place before a passing radiograph and
aforementioned test are done without permission of the SELLER, the BUYER will owe
the sum of $1000.00 dollars (one thousand) to the Seller for each litter produced.(This will
also Insure your guarantee of this contract.)
______BUYER Attest that he/she is Not nor acting for a Private or Commercial Broker/
Breeder/Kennel/Distributor, Pet Shop Owner/Manager/Employee or in the business of selling
dogs for profit or as a business/auctioneer of dog sales.
______ BUYER agrees that the sale of puppies produced by this dog or bitch will NOT be
made available to ANY owner, manager/employee, agent or individual connected with a
"Commercial or private Broker/Distributor, Commercial Breeder/Kennel or Pet Shop,
Auctions or wholesaler of dogs(Profit breeders). (WHOLESALER- meaning any individual
that buys puppies in litter lots or individual pups for their own resale, trades puppies for articles,
sells puppies by the litters, etc.) In the event that the BUYER does sell any puppy to
the above mentioned organizations, individuals, the BUYER agrees to pay the SELLER
for Damage to it's Kennel's name in the amount of $5,000.00 US Dollars.
1. Orthopedic Foundation for Animals (OFA) shows determination of hip dysplasia based on
radiographs taken between 6 months of age until your dog becomes 24 months old. This
Excludes Dysplasia Caused by: accidents, falls, blows, excessive crating (over 8 hours per day),
excessive overweight and failure to follow recommended diet.
**NOTE** Quest Stars Kennels REQUIRES THAT THE BUYER SEND A COPY OF THE
OFA EVALUATION TO THEM BEFORE ANY FURTHER ACTION IS TAKEN AS A
CONDITION OF THIS GUARANTEE. Seller "reserves the right to request" that x-rays be
repeated by a veterinarian of sellers choice and resubmitted to OFA.
2. That this dog/bitch does not pass DNA/CLEAR by VetGen for VonWillieBrands
blood disease.
3. Determination of progressive retinal atrophy or inherited cataracts by a veterinary
ophthalmologist member of the American College of Veterinary Ophthalmologists (ACVO),
provided said dog is checked once yearly and a copy of all reports submitted to seller. Seller
reserves the right to request a second opinion be obtained from an ACVO diplomat of seller's
choice. In the case of cataracts, the condition must be bilateral and of a type know to be
inherited (ie, nutritional, traumatic, geriatric, etc. cataracts do not qualify.)
4. Return of dog (buyer incurs shipping costs), or proof of spaying, castration, or by Sellers
consent of Euthanasia of said animal as recommended and provided by licensed veterinarian.
5. ***In the case of a Show Puppy, BUYER may not spay or neuter or put dog down without
first consulting with the seller and reaching a mutual agreement in writing.
______BUYER Agrees, If the Buyer chooses to keep the puppy, a certification of
sterilization must be given before any replacement or refund will be made by the
Seller. This pup must stay with original buyer and signed contract will still be
valid for care of said animal and cannot be resold. If Buyer should decide at a latter
date that it is not possible to keep said dog any longer, Buyer is to return dog to
Seller or Seller must be notified and given Name, Address and Ph. number at least
TEN (10) Days in advance of NEW Owner/s before a transfer is to be made.
*______BUYER agrees any Mis-representation to obtain or purchase above mentioned
pup OR Violations of the terms of this contract renders all guarantees stipulated in this
contract to be null & void and may result in the Buyer being required to return the dog to the
breeder within five(5) days of receipt of notice from the breeder. The Buyer will be responsible
for the cost of the dog's transport back to the breeder. If the Buyer violates this agreement, he
or she will be responsible for any/all legal costs the breeder acquires in enforcing this contract.
____BUYER agrees AKC LIMITED Registration papers will be supplied upon confirmed
receipt of spay/neuter from a licensed veterinarian.
____SELLER will supply a copy of three or more generation pedigree and copy of certified
test done on parents of said dog/bitch when this contract is signed.
____SELLER guarantees this dog to be healthy and free of known "life threatening hereditary"
defects that would make this dog unsuitable as a Show/Breeder or Pet. Up to the day the dog
reaches the age of five years, if the dog is found to be unhealthy due to hereditary problems
within the Five (5) year period, not including those due to injury, illness or neglect after sale
and such problems are documented by a licensed veterinarian. Seller may choose one of two
options provided that Buyer has complied with all other terms of this contract.
Option 1 - Seller agrees to buy the dog back at or below the original Purchase Price.
Option 2 - Seller agrees to take the dog back and provide a replacement when one becomes
available. Buyer is responsible for all veterinary costs.
____SELLER agrees, In the event that the dog should die prematurely, before age five, to
refund the purchase price of the dog if an autopsy by a licensed veterinarian shows cause
to be a Known-Testable Hereditary defect, testable at the time/date of this contract for this
Breed of dog. Buyer is to be responsible for the financial cost of the autopsy and must furnish
Seller with a copy of the autopsy report and Buyer must have complied with all other terms of
this contract.
____BUYER agrees, If at any time this dog is to be sold or given away, the Seller is to be
notified and given first option to buy the dog back at or below the original purchase price,
providing Buyer has complied with terms of contract. Buyer understands that this dog will always
have a home if needed, with the Seller.
____BUYER agrees to exercise normal care in maintaining this dog's health. Routine
preventive care includes the following: annual physical examinations by a licensed
veterinarian, annual vaccinations against DHLPP and CV, annual fecal examinations, flea
control, maintained on a HEARTWORM preventive, dental care, & rabies vaccinations
required by the Buyer's state of residence, Normal care assumes that Buyer will "maintain"
a fenced yard with access To or Close to Buyers house OR will exercise the dog on a leash.
Under NO circumstances is Dog to be tied, or chained. Also dog is NOT to be crated for any
excessive time period (8 hours). DOG WILL NOT BE ALLOWED TO ROAM FREE.
____BUYER agrees to maintain dogs coat and under No circumstances is dog to be shaved,
unless required by veterinarian care; For this breed dog, Good grooming is a must: Coat should
be brushed on a regular basis (Minimum 3 times per week) to prevent skin irritations, free of
mats & maintain cleanliness & looks. Behind ears, flanks and tail will need more attention.
*Normal care also assumes that the Buyer will feed only nationally recognized brands of dog
food of low fat content. We recommend Purina ONE Puppy or Pro Plan Puppy Lamb & Rice
or Better until the puppy is at least six months old then gradually switch over by mixing with
new change of either (Purina ONE Adult or Pro Plan Adult Maintenance).
____BUYER is to always provide this dog availability to "clean" fresh food & water
and clean food bowls.
____BUYER agrees to have the dog microchipped and/or tattooed, if not already done so
by Seller.
____BUYER agrees that the dog attend basic obedience classes.
*____BUYER agrees to have above mentioned PET puppy SPAYED/NEUTERED
between the age of FOUR (4) and EIGHT (8) months. Failure to have dog sterilized
voids all health guarantees and AKC Registration certificate and gives
Breeder/Seller right to reposess above mentioned dog anytime after
BUYER'S failure to comply with these contract terms.
____BUYER Agrees, That this animal is to "NEVER!!!" intentionally be put in a Pound or
Shelter. There are too many loving homes that will take this animal in.
____BUYER understands that Seller is available to answer questions regarding care, feeding,
and helpful hints on training of dog, at Sellers home phone number between the hours
of 10am and 8pm. Ph.1-252-358-2287
_____BUYER Promises to have Patience, Show Love and Understanding for this Animal
and To take time to be a part of "its" life; and open Your Heart to the Love this Animal
has to Share.
This contract is void unless signed by both parties.
This contract shall be governed and valid by the laws of the State of North Carolina to the
exclusion of any other forum and constitutes the entire agreement between the parties.
We have read, understood, initialed and are in Full agreement of these specified
terms of this contract.
