WILLIAM HERVEY 2nd (born ca. 1766 - died after 1843) OF HALIFAX CO., NC

[Note by Joyce Hervey. In November of 1990 I wrote to Mr. Robert Harvey of Swifton, Arkansas. I learned of Mr. Harvey through the LDS Family History Library in Salt Lake City. He had registered his interest at the library in researching his ancestor, William M. Harvey, born 1804? in North Carolina, died 1886? in Arkansas, married 1824 in North Carolina to Mary Ann Joseph Blount. Mr. Harvey's records named parents of this William Harvey as William and Frances Harvey. I had encountered these names in my research in Halifax County and believed them to be related to our ancestor, Col. Thomas Hervey; so I wrote to Mr. Harvey and suggested we share information. Mr. Harvey immediately subscribed to the Bulletin and sent copies of correspondence from a professional genealogist, a Mr. William Perry Johnson, whom he had engaged several years ago in his search for his Harvey lineage. Following are exerpts of letters from the genealogist along with some of my comments.]

Dear Senator Harvey:
"I concluded ... your Harveys ... A careful search and study of the usual sources has failed to locate positive documentary proof as to the precise parentage of your William M. Harvey. However, all circumstantial evidence points to his being son of Wm., and grandson of the William who left the 1825 will in Halifax Co., N.C. [Readers may wish to refer to Vol. 5, No. 3, June 1989 issue for writeup on William Hervey 1st.HFAV5.htm - Gen1WmHerv]

"It would appear that the wife of Wm (II) was Frances (Halifax Deed Book 18, page 498 - dated 1799 - Allen Dammeral bound to Wm. Harvey & wife Francis.) [Authors note: I have reached a different conclusion here. I believe that Frances was the wife of William 1st, based on the 1800 census which showed a young boy (assumed to be Allen Dammeral) in household of the elder William and no young boy in the household of the younger William].

"William Harvey (II) was apparently married in 1799 or 1800, and is given on 1800 Census with just himself and a female - no children. (See the census schedules sent previously). In 1800 he was listed as William Harvey Jr. (He had a brother Robert, etc.)

"Abner Harvey, born around 1801, was surely a brother to your Wm. M. Harvey. Another probable brother was Jack (usually a nickname for John) Harvey who married 1823 in Halifax Co., N.C., to M. Toney, with Abner Harvey as bondsman. Another probable brother was Samuel Harvey, of Hardeman Co., Tenn., 1840 Census, who sold land in Halifax Co., N.C., along with Wm. Harvey, in 1843 (Deed Book 32, p. 108 - see deeds in a previous report).

"Halifax Deed Book 28, p. 395 - dated 1832 - Wm. Harvey to Allen Donnevan (? - probably the Allen Dameral or Dameron who was bound to him in 1799 WPJ) - consid. $69 - 68 acres near Bear Swamp. Witnesses: Abner & Robert Harvey.

"This Robert is probably another brother to your Wm. M. Harvey (thus your Wm. M. Harvey had a SON Robert, a BROTHER Robert, and an UNCLE Robert!).

"Wm. Harvey II was born between 1760 & 1770, according to the 1830 & 1840 Censuses of Halifax Co., N.C. He either died after 1840 & before 1850, or moved away. He did not leave a will in Halifax Co., N.C. He may have married a second wife and had more children.

"I tried to place the other Harveys who were in Hardeman Co., Tenn., along with your Wm. M. Harvey. The Oney who was there early was a first cousin to Wm. M.'s FATHER, Wm. Harvey II. I do not know father of the Stephen Harvey of Hardeman Co., but WIFE of Stephen was a half-sister to ONEY!

"That name ONEY is a CLUE as to the VIRGINIA home of your Harveys. Oney or Oney S. is the name Onesephorus. One Onesiphorus Harvey left a will 1798 in the adjoining county of Northumberland in Va. Should you trace your Virginia Harveys, start with those two counties (at least 25 Harveys died in Va. between 1632 and 1800).

"One source that I have NOT tackled is Halifax Co. COURT MINUTES, since they are always so slow, tedious, expensive, etc. However, they SHOULD be checked for Harvey data! ..."

Dear Senator Harvey,
"...I feel that Abner Harvey of Halifax Co., N.C., and Hardeman Co., Tenn. (born 1801) is an older brother to your Wm. (b. 1805). I do not know whether Samuel is an older brother, or just where he belongs on the Harvey family tree. A Samuel SMITH left a will 1797 in Halifax Co., N.C., and named among others a daughter Molly Harvy. Perhaps this Samuel Smith is maternal grandfather of Samuel Harvey of Tenn. I find no record of a Samuel Harvey living in Halifax Co., N.C., but he is obviously tied in with a Wm. Harvey (which Wm.?) of Halifax Co., N.C. Note that Abner was the bondsman when your Wm. obtained his marriage bond in 1824. Your Wm. named a son Abner, too."

To the above work of Mr. William Perry Johnson, the following research and notes are added. There are a couple of conclusions made by Mr. Johnson that conflict with those made by the author.

First is the issue of which William Harvey had a wife Frances, and had documented in deed books that a boy Allen Dameron was bound to them in 1799. Mr. Johnson believed it to be William Harvey the second (b. ca. 1766), father of William M. Harvey the third. The author has stated in a prior article (Vol. 5, No. 3, June 1989) that she believes the boy was bound to William Harvey the first (b. by 1745), who died in 1825 and left a will in Halifax, and thus would be grandfather of William M. Harvey the third. Mr. Johnson believed William Harvey the second was first cousin to Oney Hervey (1776-1843) who was in Halifax early, which is probably incorrect. The above would assume that William Harvey the first (b.by 1745 - d.1825) and Col. Thomas Hervey (1740-1806), father of Oney S. Hervey (1776-1843) were brothers. It has been shown in a prior article (Vol. 7 No. 2, Mar. 1991) that William Harvey the first and Col. Thomas Hervey were probably first cousins, not brothers. Following is a list of the descendants of William Harvey 1st, taken from his Will, recorded in 1925 in Halifax Co., NC.

William Hervey/Harvey, 2nd-2 was probably the eldest child of William Hervey, 1st and his wife (probably Francis). According to census records his birth was about 1766. A study of the census records of Halifax Co., NC for 1790-1810 leads to the assumption that he probably married twice and had children with each wife. The reasoning is that the female of the 1790 census was probably not the same as the female of the 1800 census. If William's alleged first wife died and he remarried about 1800, the three boys born to the alleged first wife were living with relatives in 1800, not with William. There were indeed three boys of the right ages living with other Hervey families in Halifax in 1800, who were "extras", i.e. not accounted for in family records for those families.

The following is an attempt to identify descendants of William Hervey 2nd. The reader should understand that the listing may not be accurate. It is compiled primarily from census, deed, and marriage records of Halifax Co., NC, and census records of Hardeman Co., TN, and Jackson Co., AR.

Children of William Hervey 2nd and alleged first wife:

1. Unidentified male born ca. 1787.

2. Unidentified male born 1788/89.

3. Unidentified male born 1789/90

A Samuel Harvey (born 1780-1790) who was in Hardeman Co., TN in 1840, along with William, Abner, and Robert Harvey, may be one of these three males. On 27 Feb. 1840, Samuel Harvey of Hardeman, TN, bought from William Harvey of Halifax, NC, items of personal property including 4 feather beds & furniture, a table, 3 chests, press, desk, clock & case, 10 chairs, kitchen furniture, loom, 2 yoke oxen, 5 cows & calves, 3 heifers, 29 head hogs, wagon, 2 pairs cart wheels, 16 head sheep, 1 horse, 18 head geese. On the same date he bought from William Harvey 381 acres on Rocky Branch and Bear Swamp.

Children of Probable Second wife:

1. Unidentified male, born about 1800. Perhaps David Harvey-3 who married Nancy Mills on 20 Jan. 1820 in Halifax, NC. Bondsmen were Daniel Colema_ and Richard Eppes. The date of marriage makes him about the right age to be the first child of William and probable second wife.

2. Abner Harvey,-3 born 1801; married Charity Pritchett 20 Feb. 1821; bondsmen were William Harvey (probably Wm. M. Harvey [no. 4 below], his brother) and S. Johnston.

Abner's name appears in deed records in Halifax Co. from 1823 to 1836. In 1830, he sold Ezra Pryor 659 acres, 9 Negro slaves, 3 horses, 7 head cattle, 20 sheep, and 40 hogs for $1 to satisfy a debt owed to Pryor. In 1832, Abner and wife Charity sold 649.25 acres which Charity probably had received from her father, Christopher Pritchett; Charity appeared in court on 8 Sept. 1832 to acknowledge she freely signed the deed.

The 1830 Census of Halifax, NC showed that Abner and Charity had 4 children: 2 boys age 5-10, 1 boy and 1 girl age 0-5.

On Oct. 3, 1836, Abner signed a deed to sell land on Hawtree Creek in Halifax Co. to Lewis Shearin (his last land transaction in Halifax, NC); deed was witnessed by William Hervey and Asa Blackburn and it was proved on oath of Asa Blackburn in 1837.

A marriage record in Hardeman County, TN showed that Abner Harvey married Winney Duncan on Feb. 12, 1836. It appears that Charity died between 1832 and 1836. It is not unusual that Abner would have been in western Tennessee in 1836. He probably was visiting his relations who moved out to Hardeman and/or Dickson Co. several years before. He no doubt met Winney while he was there, married her and returned to Halifax to close out his business affairs.

By 1838 Abner was established in Hardeman Co. and remained there continuously (determined from census records) until at least 1870. More on this family will be published in a future issue.

3. Jack Harvey-3, married M. Toney on 13 Sep. 1823 in Halifax, NC. Bondsmen for the marriage were Abner Hervey (no. 2 above) and S. M. Johnston. The marriage date indicates he was the appropriate age to be the child born to William Harvey 2nd about 1803.

4. William M. Harvey,-3, born about 1805; married Mary Ann Joseph Blount (born about 1807) on 10 July 1824; bondsmen were Abner Hervey (no. 2 above) and S. M. Johnston.

The 1830 census of Halifax, NC, showed that William and Mary Ann had several children: a girl age 5-10, two boys and a girl age 0-5.

Deed Books of Halifax, NC, show several land transactions of William Hervey. On 29 Aug. 1828, William Harvey and his wife Mariann Joseph Harvey sold 50 acres to Reddick Nelms. On 13 Dec. 1828 William Harvey and Mary Ann Joseph Harvey sold 88 acres on Great Fishing Creek and Clay Branch to Cyrus Roper. Mary Ann appeared in court on 23 Feb. 1829 and again on 29 Oct. 1829 to acknowledge that she freely signed the above deeds. The land would have come to her by inheritance for her to appear in court to make such an acknowledgement. On 8 Jan. 1831 William sold 358 acres plus Negro, mare & colt, stock, cattle, and hogs to Abner Harvey to satisfy a debt past due. On 23 June 1832, William Harvey sold 68 acres near Bear Swamp meeting lands to Allen Dameron, deed witnessed by Abner Hervey and Robert Harvey. [Allen Dameron was the 5 year old boy bound to William Harvey 1st in 1799.] There were no deed transactions between 1832 and 1840. It was probably during this period that William and 3 of his brothers moved to Hardeman Co., TN, where they all appeared on the census in 1840. The last two deeds in Halifax Co., NC, involving a William Harvey were probably transactions by the senior William Harvey: On 27 Feb. 1840, William Hervey of Halifax, NC sold to Samuel Harvey of Hardeman, TN, 381 acres on a prong of Rocky Branch and Bear Swamp; witnesses were Stephen A. Harvey and Gideon P. Harvey. The last entry in the Halifax Deed books for William Hervey was on 15 Nov. 1843. At that time, William Hervey of Halifax, NC and Samuel Hervey of Hardeman TN, sold 108 acres, being the land on which William Hervey "now lives" to Gideon P. Hervey, being a little above the head of big Reedy Branch, run of Bear Swamp.

According to 1850 Arkansas Census Records, William Hervey had moved to Jackson Co., Ark. about 1848. More about this family will be published in future issues.

5. (Possibly) Frances Harvey-3, born about 1800/1810, married Sandy W. Crawley on 4 Sep. 1828. In the Will of William Harvey 1st (1825) he gave "to my granddaughter Francis Harvey my filley called Ginny".

6.Unidentified girl born 1800-1810. Possibility is Rebecca Harvey, who married John P. Johnston on 16 Feb. 1824. Bondsmen were J. Moore and S. M. Johnston.

7.Robert Harvey-3, born about 1815. He moved to western Tennessee with his brothers between 1830 and 1840. The 1840 census of Hardeman Co. shows him with a wife and daughter under 5 years old. In 1850 he was in Jackson Co., AR with an interesting family. There was a 76 year old woman Lucy (born about 1774) who was the right age to be Robert's mother and William 2nd's wife. If so, it would be the only record found which named the "second" wife of William Harvey 2nd.-2. The likelihood that Lucy was William's wife is questionable, however, because of the censuses of 1830 and 1840 of NC. In those two censuses William Harvey 2nd-2 was still alive, but there was no woman of Lucy's age shown living with William on either census. It would seem peculiar that she would not have been living with him. It would also seem odd that William would have remained in NC while his wife went to TN with her sons.

The 1850 census of Jackson Co., AR also revealed that one daughter of Robert and Elizabeth, Rebecca, was born in Miss., suggesting that the family may have lived in Miss. for a while.

8. Unidentified girl born 1810-1820. Possibility is Eliza Harvey, who married Littleton Arrington on 8 Dec. 1830, bondsmen Lewis Arrington and J. H. Harwell. Or, possibly Eliza J. M. Harvey, who married John Harold on 6 Nov. 1832; bondsmen Carter Jones and J. H. Harwell. Or, possible Francis W. Hervey, who married Wms. Hamlet on 3 June 1833; bondsmen Wm. M. West and J. H. WASHINGTON CO., PENNSYLVANIA HERVEY/HARVEY FAMILIES - Part II

[In an attempt to aid researchers working on the Hervey families of the Ohio Valley in PA, WV, KY, and OH, we are publishing a series of articles and including a number of sources documents from the area. The following are records from Washington Co., PA.]

CANTON & CHARTIERS TOWNSHIPS
A 1793 Tax List showed Frances Henery of Cecil Township. It is remotely possible that this is the same as Francis Hervey, born about 1780 in Cecil Co., Maryland and died leaving a will Mar. 1855 in Canton Township, Washington Co., PA. A published biography [J. H. Beers, Commemorative Biographical Record of Washington Co., PA, Chicago, 1893] indicated that he moved to Washington Co. in 1804 from Maryland. According to the same biography he married Jane Wherry, daughter of Joseph and Rachel Wherry, in Washington Co. in 1806 and moved to Trumbull Co., Ohio and remained there till 1817, when he returned to Pennsylvania and made his home in Canton township, where he lived until his death. Frances Harvey was in Chartiers Township (adjacent to Canton) on 1820 and 1840 Census Indexes. His Will and the entire biographical sketch is published elsewhere in this bulletin.

SKETCH OF JAMES M. HERVEY OF WASHINGTON CO., PA

[Following article is extracted from Commemorative Biographical Record of Washington County, Pennsylvania, Chicago: J. H. Beers & Co., 1893, p. 1352.]

"JAMES M. HERVEY, a well-known citizen of the County, is a son of Francis Hervey, who was born in Cecil County, Md. William Hervey, father of Francis, emigrated from Campbelltown, Scotland, to Maryland, where he died. His children were: Francis, Andrew, Benjamin, Mary, Eliza, Rachel and Esther. He was a member of the Seceder Church. "Francis Hervey spent his youth in Maryland, where he enjoyed exceptional educational advantages. In 1804 he removed to Washington County, Penn., and in 1806 was married to Miss Jane Wherry, daughter of Joseph and Rachel Wherry. Soon after his marriage he located in Trumbull County, Ohio, and remained there till 1817, when he returned to Pennsylvania, and made his home in Canton township, this County, where he lived until his death, which occurred in 1854. His family were: Joseph W., Rachel, Mary M., Elizabeth, James M., Ebenezer W., Jane A. and William. Mr. Hervey was an active member of the Democratic party, and with his family was a member of the Presbyterian Church. His wife died in 1863, and their remains are interred in the cemetery at Washington.

"James M. Hervey, the subject of our present sketch, was born November 6, 1816, in Trumbull County, Ohio, but when an infant was brought to Canton township, Washington Co., Penn., and there passed his early life. His education, being received at the common schools, was necessarily limited. On November 6, 1846, he was united in marriage with Nancy, daughter of John and Nancy Morgan. The young people began their married life in Chartiers township, and remained there till 1853, when they removed to their present home in Mt. Pleasant township. They have three children: John M., Meletta and Joseph W. Politically Mr. Hervey is a Democrat, and in religion a member of the Presbyterian Church. He is known as an upright citizen, one who has made a success of life by his own industrious efforts, and is intelligent and well informed."

"The last will and testament of Francis Hervey. I Francis Hervey of Chartiers Township Washington County Pa being of sound mind memory and understanding do make publish and ordain this my last will and testament _____ form following that is to say; In the first place, I confide my soul to God who gave it and my body to the dust from whence it came, and as to such worldly property as it has pleased God to intrust to me, I dispose of in the following manner. 1st To my beloved wife Jane in case she should survive me, I bequeath one third of all my property, during her natural life, and at her death to revert to my son William 2d to whom I give the remainder of my property on condition of him paying all my honest and just debts, funereal expenses, and all the expenses of settling estate, and to devise the following legacies. 3d To my daughter Rachel intermarried to Welliam Linn, fifty dollars. 4th To my daughter Mary Margaret, intermarried to Edward J. Morgan, fifty dollars. 5[th] To my son Joseph W. Hervey, fifty dollars[.] 6th To my son James M. Hervey two hundred dollars. 7th To my daughter Elisabeth Hervey three hundred dollars. 8th To my daughter Jane Ann Hervey five hundred dollars. I do hereby constitute and appoint William Hervey and Edward G. Cundall, my Executors to carry out the provisions of this my last will and testament. In witness whereof I the above named Francis Hervey, the Testator, have to this my last will writtin on one sheet of paper, set my hand and seal this 15 day of October, one thousand eight hundred and fifty-two. Francis Hervey {seal}The within writing on one sheet of paper was signed and sealed by the above named Francis Hervey and by him published as his last will and testament, in the presence of us, who have hereunto subscribed our names in his presence and the presence of each this the day and year above written. My name is Sharon Hervey Schul and I have a bulletin for the Hervey Families dated December 1984. We are a small branch up here in Idaho and I'm sorry none of us has gotten busy long before now to do some genealogy. In the course of helping a cousin with my mother's side of the family (McNees), I've gotten very interested, and in that regard, would appreciate corresponding with you regarding the Hervey side. ... For your information, all we know about our father was that his name is Elvin Victor Hervey and he was adopted in Chicago, came to Idaho with his adopted parents, was an only child, and has lived here all his life. [Grandparents] Charles Montgomery Hervey & Valorus Edwards married April 14, 1897, McLean Co., IL. [Father] Elvin Victor Hervey; born June 2, 1906, adopted Sept. 6, 1907 through Children's Home and Aid Society, Chicago, IL, mother was Frances Zumwalt. [They] moved to Roswell/Parma, Idaho when Elvin was very young along with Mr. Hervey's sister and husband, Mabel and Edward Sloan (son Richard) where both families farmed. Elvin's mother died when he was around 10 years old and when his father started work as a rural mail carrier, they moved into town (Parma) and lived at the Allen's boarding house. Elvin was an excellent athlete in baseball, basketball, tennis and swimming. He attended the University of Idaho on scholarship. Elvin Victor Hervey & Esther Irene McNees married Nov. 12, 193_, Roswell, Idaho. Moved to Boise, Idaho approximately 1936-7 and took employment with the Idaho Super Service (service stations) during the depression and eventually started driving taxi cab which he did until retirement. Children: Charles Benjamin, Sharon Emma, Robert Lee.

... My brother, Charles, and I have adopted our children and Robert is the only child carrying on the Hervey name through his son, Kenneth. Incidentally, our father, Elvin, is still living and is a spry 85 years old.

I am descended from Col. Thomas Peyton Hervey's daughter Hannah who married John (Bull) Randal. Their oldest son Oney Cypress (Bull) Randal (b. 1796) is my gr gr great grandfather and he moved from NC to Franklin Co., GA with his parents in the early 1800's. The rest of my line of descent is Albert Gallatin Randal/Randle, John Henry Randle, of Union Co., MS, Leslie Curtis Randle, Stacy Boyce Randle, my Father.
