Wells, of the town of Ashley, County of Pike, and State of Missouri. I give to my wife the homestead, containing eighty five acres. (85) Sub-division one, Survey 1714, Twp Fifty two. (52) Range three (3) West. to have and hold during the term of her natural life and at her death it is to be divided equally between my son Job T. Wells, or his heirs, and Emma J. Wells or her heirs. I give all my Lemuel, was born June 10, 1807 in Bottom, WV. Married January 1, 1854. He dealt in land warrants and laid them on the public domain, which comprised a large portion of the prairie country, Pike county, and added a still larger area of prairie land in Hartford Twp, being perhaps the largest single owner of real estate in Pike county prior to the Civil War. He was the owner of slave labor and drew his revenues from field and meadow. He lead the advance for making provisions for the higher education of youth in the establishment of a college in the midst of the Ashley community, and favored the plan to inaugurate the career of Watson Seminary an educational institution, making a liberal contribution of money and a site for that purpose, in addition to giving his personal effort towards that end, and can, therefore, be mentioned as a prime personal factor in the creation of this historic institution. His belief in the system of slave labor and the profit which accrued to his household by reason of ownership of such chattels arrayed him against the government in its efforts to restore order and put down the rebellion of 1861. He did not get into the conflict of arms, but came into conflict with the strong arm of government by reason of his seditious sentiment and of his irrepressible Confederate spirit. He was placed under arrest on seven different occasions and was imprisoned and order to be executed twice during the war. He was arrested, among other Confederate sympathizers, for a crime committed near Macon, Missouri, which caused the death of one person, and he was one of sixty drawn to be shot. Of the sixty, thirty were chosen, of which he was one, and out of this number, twelve men were drawn who were decreed to pay the penalty, but his name did not come out of the box as one of the twelve, and he was subsequently released. Upon another occasion he was the victim of Federal displeasure, as a prisoner in Gratiot street prison in St. Louis. His importance as a leader among the promoters of rebellious sentiment was recognized by the government and his removal summarily was decided upon. News of this decision reached his wife and she started for Federal headquarters of the Federal military to plead his cause, and, if possible to save his The ''Big Wells'' Family (10-8 continued - Information about Lemuel M. Wells) life. Just the night before he was to have been shot she appeared at the famous old jail with a pardon for her husband, and restored him to his family. He died May 8,1882 in Ashly, MO. personal effects to my wife, my son Job T. and my daughter Emma J. subject to the following conditions and specifications: I give to my brother Dudley Wells One Hundred and Fifty Dollars more or less, the balance due on my note he holds against me. I give to Mrs. Mary Howe Two Hundred Dollars due her for services in raising my daughter Emma J. I give to the heir of Mrs. Lucy Wells One Dollar. I give to Lemuel Wright, my grandson and namesake, One Hundred Dollars to be paid to him when he is twenty one years of age. I give to each of the four daughters of Rachel Reid viz: Annie Wright, Nettie Copenhaver, Ophelia Parsons and Lillie Moore, the sum of Twenty Five Dollars and to her other heirs the sum of One Dollar and to George Johnston the sum of Twenty Five Dollars and to the other heirs of Mrs. Bettie Gillum One dollar. I will that T. J. Elmore's bill of lumber furnished and work done in building the sheep house be paid out of my personal effects. Also the Doctors' bills, the bill of D. M. Bowen, Noah Bells wages for the summer of seven months, at sixteen Dollars per month and my funeral expenses. I give to Mrs. Theodore Purse,, Mrs. John Wright, C. P. Wells & James Wells each the sum of One Dollar. And after paying the above specified sums the remainder to be divided among my wife, Job T. and Emma J. in the proportion of One Thousand Dollars to my wife, One Thousand Dollars to Emma J. and Eight Hundred Dollars to Job T. One four year old bull. One sow and eight pigs. All my farming implements, including my stacker and mower, one prospective colt from my daughter, Emma J.'s mare, or any other personal property that may be found not mentioned in the foregoing schedule, to be by him, the said executor, distributed according to the provisions of the aforementioned will, with the addition of paying to Clay Wright Thirty Dollars the amount in full due him. I will that all other receipts and incomes arising from the settlement of my estate, to be divided equally between my son Job T. Wells and Emma J. Wells of the County of Marshall and State of Virginia being in sound mind but of feeble health do make and publish this as being my last will and testament. First - I do will, grant and bequeath to my beloved wife Rachel Wells all of the household and kitchen furniture together with the stock and farming implements and utensils now in use upon said premises and owned by me. Also all of my black servants consisting of five. Also all of the railroad stock that I hold in the Cincinnati and Marietta Railroad in the State of Ohio. Also one hundred dollars worth of grain each and every year during her natural life from the proceeds of the Home Farm where I now reside. Also the Home Mansion where I now reside, with stables, barns, gardens and orchards together with all the appurtenances and privileges, rents, etc. that have accrued or may hereafter accrue from the one hundred acres of land attached to the Home Mansion, which is not rented at this time. To have and to hold the same for and during her natural life and at her death I desire that the personal property, or so much thereof as may remain, to be sold and the proceeds thereof to be paid to my-sons Dudley and Lemuel Wells as part of Ten Thousand Dollars to each of them. My five servants, above designated, I desire to divide at the death of my wife between my sons Rolla N. and Charles C. Wells my five servants above designated - or they may sell them to my sons Lemuel and Dudly Wells as further payment upon the above specified sum - but I do not desire them to be sold at public sale. Second- I do hereby will, grant and bequeath to my son Rolla N. Wells sixty five acres of land - more or less - on the north side of my farm: Beginning for the same at the southwest corner of Rolla N. Wells farm on the bank of the Ohio River in the County of Marshall and State of Virginia; thence down the river bank about one hundred and twenty rods to stone; from thence on a line with a post and rail fence direction North 60 degrees East to the County Road; thence up the road to the first run (known as Sugar Camp Run) thence up said run to the Mccolloch line; thence up said line to stone pile; thence along the South line of Rolla N. Wells in Marshall County, Virginia. To have and to hold the same for his heirs and assigns forever. Fourth - I will, devise, grant and bequeath to my daughter Rachel Austin all the remaining portions of my land not included in the above bequests that lies in Marshall and Wetzel Counties, Virginia- Fifth - I will, devise and bequeath to my sons Lemuel M. Wells and John D. Wells the sum of Ten Thousand Dollars each to be paid as hereinafter provided. Sixth - I desire that the net proceeds of the rents of the above lands bequeathed by me to Rolla N. Wells, Charles C. Wells and lands Rachel M. Austin, after the payment of taxes and keeping said in good repair, shall be put at interest by my executors annually until it shall amount to a sufficient sum to pay the bequests to my sons Lemuel M. and James D. Wells but I further desire that said Lemuel M. and James D. Wells shall receive the net proceeds of the rents of the lands aforesaid annually provided, that, they, of the rents of the lands aforesaid will pay the interest but not otherwise. Seventh - I desire that my executors shall complete or enter into a written contract with Henry, William and Timothy Yoho for the rent of one hundred and seventy five acres of land - more or less at Five Dollars an acre, for four years commencing March first A.D. 1856. Also with Robert Kirkpatrick for ten acres of land, more or less at the mouth of Proctor Creek, with house, blacksmith shop and tools at Fifty Dollars per year for four years commencing March first A.D. 1856 and at expiration of Kirkpatricks lease I desire the smithing tools to be sold. Eighth - I desire that Charles C. Wells shall sell at a proper time a lot of cattle owned by Charles C, Wells and myself, and pay over my half of the money to Lemuel M. and James D. Wells as a portion of the Ten Thousand Dollars allotted to each one of them. Ninth - I will and bequeath to my wife Rachel Wells my horse Toby, also three colts - now at Charles C. Wells - one of them one year old, the other two, three years old. And to Charles C. Wells I bequeath one colt known as the Morgan Colt. And to Rachel M. Austin, one gray mare called Sue, now with foal, but if she does well and the colt lives, I desire the colt to belong to my estate when it is weaned. Tenth - Whereas I am the executor of the estate of Elizabeth Wells, deceased, which remains in an unsettled condition - if upon the final settlement of said estate there should be money due from me, I desire that each one of my heirs shall pay an equal portion of the same - and do hereby bind them severally and jointly.   • Birth*: 6 April 1745; Baltimore Co., Maryland, USA; Information on Charles Wells Charles Wells (1745-1815) The first settler in the Sisterville area, he came there about 1802 from Maryland. In 1800 he had surveyed a 200 acre tract on the Ohio River at ''Long Reach'', a 20 mile stretch of the Ohio River near Sisterville. Around 1802, he took his family and possessions and floated down the Ohio River on a flatboat from Wellsburg, to land one mile below the present site of Sisterville. Wells represented northwestern Virginia in the State Legislature for eight years between 1789 and 1810. He told of many Indian raids in correspondence with the Governor of Virginia. Wells had established a horse mill at his new home, and rented rooms in his log house for a store and merchant's shop. Gradually, others arrived, and ''Wells Landing'' or ''Ziggletown'' as it was once called, became a small community. Wells owned the high bottom lands of Sisterville, as well as other lands up and down the river. In 1813 he acquired 400 acres of land on which Sisterville's central business area is located. Tyler County was organized in 1814 and the first county court was held at Wells' home in 1815. Twice married, Wells had ten children by his first wife, Mical Owings, (1745-1783), and at least nine by his second wife, Elizabeth Prather (1765-1845). The ninth child born to his second marriage was in 1797, was named Twenty Wells. They were Delilah and Sarah Wells, daughters of Charles Wells. Charles Wells (1745-1815), who was twice married, was a native of Maryland. When he was twenty he married Rachel Owings, a Maryland girl, on December 20, 1764. In 1775, Charles and Rachel migrated to present day Brooke County, West Virginia. In the brief married life of the couple, Rachel presented her husband with 10 children. After her passing, Charles Wells married again. His second wife was Elizabeth Prather, whom Wells married on July 24, 1784. By Elizabeth, Wells had a dozen more children, making him a family of 22 sons and daughters. Sarah and Delilah were Charles Wells' 18th and 19th children. Sarah married John McCoy a year or two following her father's death in 1815 and Delilah married Robert Grier about the time her father passed away. The 20th child was named Thankful. His 21st was named Plenty. His last, the 22nd, was given the name of Betsy. Two of Charles Wells' grandsons were Barney and Ephraim Wells. For eight years, (four terms) during the period of 1789 to 1810, Charles Wells represented northwestern Virginia in the state's legislative halls. When Wells died he was laid to rest in the old cemetery on the southern approach to Sisterville. It was 150 years ago this year that he died. NOTE: Tyler County is one of West Virginia's oldest counties, having been formed on December 3, 1814, a hear before Wells death. In March of 1777 Charles purchased 1075 acres of land from George McColloch on a head branch of Buffalo Creek on the Virginia side of the state line. He returned home and sold hid Maryland property to his father and, with his wife and seven children, moved to their new home on the frontier. To my daughter Sarah Wells I give and bequeath a part of the tract of land I purchased from James Caldwell; beginning at the mouth of Whittens Run and running with the wagon road now leading to the Jug Handle Mill to the upper end of the Tanyard Lot, thence up the Run to the back line, thence with said line so far that a due west line come to the corner of the fence as it now stands that divides Simon Seamons and Lemual Scott lots; thence with the meanders of said fence to the River bank; thence with said river bank to the place of beginning be the same more or less; to her and her assigns forever. Also one half of a Tract of Land I located the 9th of May last in Ohio County Land Office, adjoining lands of the heirs-of John Williamson deceased; containing Four Hundred Acres; to her and her heirs or assigns forever. To my daughter Delilah Wells I give and bequeath all the residue or upper part of the aforesaid tract of Land purchased from James Caldwell whereon Samuel Scott now lives: also the one half of the aforesaid Tract I located the 9th of May last; to be divided by a straight line from the River bank between her and her sister Sarah, and her to have the lower part adjoining her other land. To my daughter Katy Adams Wells I give and bequeath all that Tract of Land I purchased from John Rolf, adjoining land of Joshua Howard, Thomas Jones and others, said to contain Five Hundred and Sixty-five Acres more or less; also Five Hundred Dollars to be paid by my executors, to her and her heirs and assigns forever. To my daughter Betsy Prather Wells I give and bequeath all that Tract of Land I purchased from Jeremiah Clemons adjoining Lands of Nicholas Wells and Thomas Cochran, said to contain Three Hundred and Fourteen Acres; to her and her heirs and assigns forever. Item 13. To my granddaughter, Ruth Wells, daughter of Nicholas and Rachel Wells I will and bequeath that she have at the time of her marriage or attaining the age of twenty-one years, One Horse and Saddle to be valued to One Hundred Dollars; and One Hundred Dollars in cash to be paid by my executors. Item 14. To my Executors of this my Last Will and Testament hereafter to be named, I will and bequeath One Hundred Dollars to each of them. Item 15.
