Narrative

There is another child, Mabel Evelyn Snooks born Torquay 1 September 1908 baptised at Ellacombe but parents are Charles and Mabel Snook. Les T

In fact my grandfather told me that his mother used to send food parcels to her widowed sister Patience Snook (another granddaughter of Elizabeth Trenaman and Thomas Ellacott) in Torquay before World War I.
from Joy walker, Book 6a / E-mails / 13 / page 8

Narrative

** Patience married Edwin Snook twice ? 18 April 1892 and 11 September 1892

I can see 2 points,
1/ Her name is wrong on the Banns for the first marriage, she is down as Patience “Heligate”.
There is no sign of a previous marriage, anyway she married twice as “Ellacott”
Could this technicality have made the wedding void ?

2/ Edwin was still married to his first wife !!
He married Susan Hurvid 3q 1866 when he was 19 and she 15 years old.
1871 census they are together with no children.
1881 and 1891 census Edwin is on his own but down as married.

Could it be that he was still married and after marring Patience in April, he was caught and had to get an Annulment of the first marriage to Susan or a divorce before marring Patience in the September 1892. [Getting a divorce would have taken more that 6 months, even if they could afford it, which is very unlikely]

Susan Hurvid remarried under her maiden name 3q 1892 to William G Tucker.
On both of Edwin marriage certificates to Patience, they are down as Bachelor and Spinster.

The second marriage certificate shows them living at different addresses but their first child May is born 1q 1893 about 6 months after the September wedding.

When you can annul a marriage UK law 2015 www.gov.uk/how-to-annul-marriage

Annulment is a way of ending a marriage, like divorce.
Unlike divorce, you can get a marriage annulled at any time after the wedding (in a divorce, you have to wait at least a year)

You may want an annulment if you have religious reasons for not wanting a divorce.
However, you need to show that the marriage was either not valid in the first place, or is defective for one of the reasons given below.

1. Your marriage is not legally valid - ‘void’ marriages
You can annul a marriage if it was not legally valid in the first place, eg:

You are closely related
One of you was under 16
One of you was already married or in a civil partnership

If a marriage was not legally valid, the law says that it never existed.
However, you may need legal paperwork to prove this - eg if you want to get married again.

2. Your marriage is defective - ‘voidable’ marriages
You can annul a marriage if:

It was not consummated - you haven’t had sex with the person you married since the wedding (does not apply for same sex couples)
You did not properly consent to the marriage - eg you were drunk or forced into it
The other person had a sexually transmitted disease when you got married
The woman was pregnant by another man when you got married

Marriages annulled for these reasons are known as ‘voidable’ marriages.
