WHEREAS, I Joshua Hatch of Leicester, in the County of Worcester
considering the uncertainty of this mortal life do make and publish this my
last Will and Testament in the manner and form following.

First, I order and direct my executor hereafter named to pay all my just
debts and funeral charges.

I give and bequeath to my son, Joshua Hatch, my wearing apparel and that
bed and bedding that was his mother's and it is my will that all the remainder
of the household furniture which I had by my wife should be equally divided
between my son Joshua, aforesaid, and my daughter Priscilla [Pisily, Pisoly,
or possibly Pixty].

I do authorize and direct my executor to sell my land in Spencer
[Worcester Co., MA] to make and execute a deed or deeds of as much land, as
with my cattle and sheep, one chain saddle and bridle not hereafter given
away, for the payment of my just debts and costs of settling my estate.

I give and bequeath to Ruth Reed, a single woman who has been my
housekeeper ever since the decease of my wife, as a compensation for her
service, all the use, improvement and income of my homestead farm dwelling
house, barn and other buildings for and during the term of her natural life.
Also, my farming tools, two cows, six sheep and swine, all the provisions that
may be remaining on hand after the settlement of the Estate and also one bed
and bedding with the remainder of the household furniture not before given
away for her use and disposal with the libery of cutting as much firewood as
will be sufficient for one fire and no more except to repair building and
fence and manage the farm in all respects according to the rules of good
husbandry and after the decease of said Ruth, the use and income of the said
homestead farm shall be equally divided between my son, Joshua, and my
daughter, Priscilla, or to each of their heirs and to their heirs and assigns
forever and all the rest, residue and remainder of my estate, goods and
chattels of what name or nature soever that may be remaining after the payment
of the debts and costs of settlement be paid, shall be equally divided between
my son, Joshua, and daughter, Priscilla.

I do hereby revoke all former Wills by me made and appoint Peter
Silvester of Leicester in the County aforesaid Executor of this my Last Will
and Testament. /s/ Joshua Hatch.

In Witness whereof I the said Joshua Hatch have here unto set my hand and
seal this Twenty third day of December in the year of our Lord One Thousand
eight hundred and sixteen.

Signed, sealed, published and declared by the said Joshua Hatch above
mentioned to be his Last Will and Testament in the presence of us, who at his
request, and in his presence, have hereunto submitted our names as Witnesses

To all people to whom these presents shall come, Nathl Paine, Esq., Judge
of the Probate of Wills & in the County of Worcester within the Commonwealth
of Massachusetts sendeth Greetings.

Know ye that on the sixth day of June Anno Domini 1820 the instrument
hereunto annexed [presumed] to be the last Will and Testament of Joshua Hatch
late of Leicester in the County of Worcester, deceased, was presented for
Probate by Peter Silvester the executor therein named, then present William
Silvester, Claton? R or C Silvester & Peter Silvester the Witnesses thereunto
subscribed who made oath that they saw the said Testator sign and seal & heard
him declare the said instrument to be his last Will and Testament & that they
subscribed their names together as Witnesses to the execution thereof in the
said Testator's presence and that he was (to the best of the depondents'
judgment), of sound and disposing mind.

I do therefore prove, approve and allow the said instrument as the last
Will & Testament of the above named dec'd and commit the Administration
thereof in all matters the same concerning and of his Estate whereof he died
seised and possessed in said Commonwelath unto Peter Silvester the before
named Executor with and faithfully to execute the said Will and to administer
the Estate of the said Deceased according thereto, who accepted said trust and
has given Bond to exhibit an inventory of said Estate into the Probate office
in said County within three months and to render an account (upon oath) of his
proceedings when thereunto law fully require.

In Testimony Whereof, I have hereunto set my hand and seal of office the

Greeting. You are hereby appointed and empowered on oath to take an inventory
of and according to your best skill and judgment truly and justly to appraise
at the present true value thereof in lawful money of the commonwealth all the
estate whereof of Micah Hatch late of Spencer, deceased, died intestate in the
aforesaid county, and you ____ make return of the warrant with your doings
thereon unto the Probate office in the same county as soon as conveniently may
be. Said estate will be shewn you by Joshua Hatch Administrator of the Estate.
Given under my hand this 2nd day of November, A.D. 1784.

Commonwealth of Massachusetts and present here today, Greeting --

(Seal) Pursuant to the power and authority to me given in by the laws of
Massachusetts, I do hereby authorize and appoint you the above named three
persons a committee, on oath, to appraise all the real estate whereof Michael
Hatch last of Spencer in said county, yeoman, deceased, intestate died vested
and possessed in said commonwealth in his own ________ right in fee simple
cash price ________ by offset with their names of distribution _______ and
bounds and number of acres at the present true value thereof: in lawful money
all in words at length (which was heretofore set off to his widow). When you
have perfected your inventory, you are to set off and distribute the same to
and among the children of the said deceased, or their legal representatives,
or so many of them as the same will conveniently accommodate without prejudice
to, or spoiling the whole. Preference being had to ________ and in all deal
impartially as you are sworn, to the oldest son a double share. Moreover, if
any of the children of the said deceased have received anything of him in his
lifetime in advance toward their portion (not heretofore considered, you are
to signify the same to me and how much cash one has had. When you go about
your work let all parties concerned have notice, and if any disputes arise
about the quantity of any parcel of land, you may procure an assistant for the
survey thereof and if all said parties are satisfied with your providings let
them signify the same by countersigning. Finally seal up this commission with
your doings thereon and return the same with convenience [then a scratched out
partial sentence] of Probate by _____ or one of yourselves. Given under my

named William White, Jonas Bemis and Nathan Craige and made solemn oath that
in appraising and dividing the estate of the within named Michael Hatch they
would act faithfully and impartially according to their best skill and
judgment before me John ______, Justice of the Peace.

To the Honorable Joseph _________ Esq., Judge of the Probate for the County
of Worcester. Sir, in compliance with your commission to us directed we have
appraised the whole of the real estate of Michael Hatch late of Spencer in
said county, deceased, intestate, died ________ [not a date] and possessed
[referring to his property] which was heretofore set off to his widow as his
heir. The same being 17 acres and is bounded as follows, viz: Beginning at
the county road at the South West corner, then running North 4 degrees west
one hundred sixty rods by Wright Woodard's land to a stake and stones, then
running East 4 degrees north by Oliver Watson's land sixteen rods and three
quarters to a stake and stones; thence running South 4 degrees east by Joshua
Hatch's land one hundred and ten rods; then running West about two rods by
said Joshua's land to a stake and stones, then running South 4 degrees east to
a stake and stones thirty five rods by said Joshua's land; then running East
by said Joshua's land ten rods to a heap of stones on a rock. Then running
South 4 decrees East by said Joshua's land fourteen rods and one half to a
stake and stones on the country road, then running West by said road twenty-
four rods and three quarters to the first mentioned corner. Also, one third
part of a dwelling house standing on said Joshua Hatch's land for the
particular of said house as well as the _________ [appurtenances?] around the
same and belonging thereunto. Performance is had to the return of the
committee that set off said heirs as the said return is on record in the
Probate Office in said county will more fully appear. All which we appraise
at Two Hundred and Forty Dollars and when we come to view the ________ with a
view of making a division to and among the heirs, we found that there could be
no division without very essentially injuring the whole, therefore we have
assigned or set the whole of said real estate appraised at Two Hundred and
Forty Dollars to Joshua Hatch, son of said deceased, and we ______ or assigned
for him to pay to each of his brothers and sisters hereafter named, or their
heirs, the sum of Thirty Dollars in three months from this time with interest.
The names of the several(?) Heirs of said deceased Hatch of which the
aforesaid sum of Thirty Dollars is to be paid in manner as aforesaid, as
follows, viz: the heirs of Priscilla Reed, late wife of Mr. Timothy Reed, now
deceased; Sarah Jewett; Thankful Sprague; Michael Hatch; John Hatch; and Rhoda
Hatch; [note, the heirs, with the exception of Joshua who is the oldest, are
listed in birth order] and the said Joshua Hatch is to retain in his own hands
for his legacy the sum of Sixty Dollars, it being a double share to said
Joshua, which sum together with what we have assigned for him to pay to the
other heirs is the full sum we valued said real estate at, and there is
nothing apparent that any of said heirs has received of said deceased in his
lifetime in advance towards them ______.

appointed to appraise all the real estate whereof Michael Hatch, late of
Spencer in said county deceased ______ _______ in Massachusetts which was set
off to the widow of said deceased for her dower, she being now deceased and
the said __________ _______ _____ to be recorded and the said estate having
been appraised at the sum of Two Hundred and Forty Dollars X and it appearing
that the same will not admit(?) of a division among all the heirs, I therefore
assign the ___________ as herein described to Joshua Hatch, the oldest son of
said deceased, he having agreed to accept the same. To have and to hold, the
same to him, his heirs, and assigns forever upon a condition that he shall
pay, or cause to be paid, to the other children of said deceased or to their

Vital Records pages 465 and 488. According to the death record of the Michael
that married Martha Rice, Michael died age 83; his birth would be 1747/48.
