In the name of God amen I Richard EDMONDSON of Holme in the Parish of Burton in the County of Westmorland glover [being sick etc] declare this to be my last will and testament as followeth First I give unto my loving wife Maryan Edmondson the dwellinghouse wherein I now dwell being freehold situate at Holme aforesaid to hold for her natural life [with all rights etc] and after her death to my son Richard Edmondson chargeable with my wife and son paying out of the same one half of my debts and funeral expenses I give to my daughter Ann CLEMMY wife of Thomas Clemmy my Customary dwellinghouse [with all rights etc] holden under the Hon Frances CHARTERS Esq by the payment of rents fines & services therefore due according to the custom of the manner [sic] of Holme aforesaid chargeable with the payment of the other half of my debts [etc] and last I give to my wife Maryan all my personal estate [etc] and I appoint her my sole executrix.
Dated 5 August 1768 and witnessed by George BATESON, Edward THOMPSON and Jno SMYTH.
Added to the transcript is the following:
On the 28th February 1782 administration with the will annexed of the goods of the said Richard Edmondson deceased was granted to Richard Edmondson and Ann Clemmy son and daughter of the deceased and devises named in the will Maryan Edmondson the executrix named in the will having departed this life in the lifetime of the testator.

Just debts and funeral and testamentary expenses to be paid.
To my wife Jane all my stock in trade and such part of my household furniture as she elects to take within one month after my decease.
All the rest of my personal estate to my sons Thomas Chamney ELLERAY and Stephen ELLERAY of Winster and to my sons in law Christopher STALKER and Roger FLEMING of Ambleside upon trust to sell and dispose of the same. The proceeds arising from such sale to be paid into the Banking House of Messr. Wakefield and Sons of Kendal at interest for purposes hereinafter described.
To my trustees all my estate called Socald Tenement at Winster and all the other properties at Winster (except the two Cottages and orchard devised to my daughter Mary ELLERAY) with all their appurtenances and certain Moss Dales in Cartmel Mosses in Lancashire.
My trustees shall deposit the rents and profits of the said properties into the banking House of Messrs. Wakefield & Sons upon trust that they, my trustees, shall in the first place pay an annuity of thirty pounds to my wife Jane during her life. The payments to be made in equal half yearly portions at May day and Matinmass day, the first payment to be made at the first of these days after my decease, the same to be taken and received by her in satisfaction of all dower and thirds she may be entitled to.
After paying the said annuity and other payments hereinafter mentioned, when the fund accumulates to one thousand pounds I direct that my trustees shall pay the sum of two hundred pounds apiece to each of my daughters:
Agnes the wife of Christopher STALKER, Mary ELLERAY, Margaret the wife of sd. Roger FLEMING, Isabella the wife of Robert MATTY of Liverpool, and Betsy the wife of Joseph STALKER of Keswick.
After payment of the above legacies:
To my son Thomas ELLERAY (charged with the payment of two hundred pounds in case my estate should have to pay off the two hundred pounds to John DIXON of Brundrigg to which I have become surety with my son Thomas) the dwelling house in Winster commonly called the Ancient Fire House with the out buildings, garden, orchard and appurtenances now occupied by my daughter Mary ELLERAY and my son Stephen and also all the buildings and offices therewith now in his, my said son Thomas�, occupation with the Orchard behind and adjoining the same Houses and all the parcels of ground situate at Winster called High Intack Middle Intack Wood Intack and the two fields called Grub Lands with croft ??? Field Well Meadow Pattys orchard Kelsick Meadow and orchard and also one half (the whole into two equal half parts to be divided between my son Thomas and my sons William and Stephen and the expense of fencing of the same to be paid by them in the like proportions) of the parcel of land called the Allotment which I have recently taken in from Winster Common and also all the rest of the Common or newly improved common lands which I have at Winster except the two acre field given to my sons Stephen and William below.
To my sons William ELLERAY and Stephen ELLERAY during their lives and the longer liver of them (chargeable with the payment of one hundred and ninety pounds in case my estate should have to pay off one hundred pounds to John DIXON of Brundrigg and ninety pounds to my son in law Christopher STALKER for which sums I have become surety with my son Stephen) my Mill and the Malt kiln with the kitchen I some time ago erected and built into the house hereinbefore devised to my son Thomas and the gardens therewith in Winster and the closes of land called Mill How Ninevih Orchard Dam Meadow Peaselands Parrach near House End and also my dwelling house at the Head of Winster and all other out buildings and appurtenances garden and orchard as the same is now occupied by Isaac Swainton as Tenant and also the several Moss dales in ??thwaite and Lutherbarrow Moss in Lancashire and also all the newly taken in Field in my own possession which lies the highest up the side of the hill called Steal containing about two acres and also the other half of the parcel of ground called the Allotment.
In case of the death of both my sons William and Stephen without lawful issue, the properties to be equally divided amongst the lawful issue of my sons John ELLERAY and Birket ELLERAY.
To my daughter Mary ELLERAY my two cottages and orchard in Winster which were late the property of Charles BIRKETT.
To my son Birkett ELLERAY two hundred pounds; fifty pounds to be paid within one year after my decease for his maintenance, fitting out and qualifications to practice as a Surgeon and the remainder to be paid as my wife sees fit; such sums to be paid out of the proceeds and accumulations of my real and personal estates.
The money advanced to my son John ELLERAY shall be deemed to be an advancement and he shall not be accountable for the same to my Estate. My trustees may, with consent of my wife if living, advance to any of my daughters up to fifty pounds of their legacies providing that they or their husbands agree to pay interest on the advancement at the rate of four pounds per centum per annum from the advance thereof up to the time when they are to receive the whole of their respective legacies.
I nominate Thomas Chamney ELLERAY, Stephen ELLERAY, Christopher STALKER and Roger FLEMING the Executors of this my will.
In witness whereof I Birkett ELLERAY have to this my last will and testament contained in eight sheets of paper to the first second third fourth fifth sixth and seventh sheets thereof set and subscribed my name and to the eighth and last sheet hereof my name and seal this sixteenth day of February one thousand eight hundred and twenty eight.
Codicil dated: twenty ??? of November 1828

Whereas I Birkett ELLERAY of Ambleside in the county of Westmorland, yeoman made and executed my last will and testament dated sixteenth day of February one thousand eight hundred and twenty eight and I now make this as a codicil to be annexed thereto and to form part thereof.
Whereas I devised to my daughter Mary ELLERAY my two cottages and orchard at Winster I now direct that the same be conveyed to her when the other legacies become payable. In the mean time the rents thereof to be added to the value of my Estate.
I authorise my Trustees to extend the advance of fifty pounds to the different legatees applying for the same to the sum of seventy pounds upon the terms as mentioned in the will.
I revoke the devise of the Peat Moss and Dales and now devise the same in equal moieties between Thomas and Stephen and William. Thomas to take one half and Stephen and William the other half.
In witness whereof I have to this my codicil contained on two sheets of paper to the first sheet signed my name and to this last sheet my name and seal this twenty ??? day of November 1828.

To my executors all my farming stock and household furniture to sell the same an to pay the following legacies:
To my grandson Robert ELLERAY, the illegitimate son of my late daughter Jane the sum of two hundred pounds on his attaining the age of twenty five years; in case he should die under that age without lawful issue then the two hundred pounds to be given in equal shares to Robert the illegitimate son of my late wife and my daughter Isabella.
To each of my two granddaughters, the daughters of my said daughter Jane I give fifty pounds each on their attaining respectively the age of twenty five years
To my daughter Isabella during her natural life and after her decease to her son William on his attaining the age of twenty five years subject to his paying fifty pounds to each to his sisters Agnes, Jane and Anne if he (William) should die without issue then to his brothers and sisters as Tenants in Common, my three Cottages or Dwelling Houses Gardens and three inclosures of land called the Intacks with a coppice of wood called Wood Intack situated in Winster aforesaid
To Robert the illegitimate son of my late wife during the term of his natural life and after his decease to his eldest son Thomas subject to the payment of one hundred pounds each to his brothers and sisters John, Stephen, Ann and Mary my estate called Salkeld Tenement situate at Winster aforesaid and all other my Real Estate whatsoever and wheresoever.

Whereas John CREWDSON of Stramongate, weaver and Richard CREWDSON his father of Crook, yeoman by a bond bearing date fifth of February 1697 became bound to me and to John ELLWOOD of Orest in Applethwaite yeoman my son in the penal sum of twenty pounds for the payment of ten pounds and ten shillings, I give the sum of five pounds being my share of the ten pounds to my son John ELLWOOD, he to take possession within two years next after the decease of the survivor of myself and my wife Genet ELLWOOD.

To my son in law Robert LAWSON of Lancaster and my friend and relation William BACKHOUSE the elder of Kellet, both in county of Lancashire, all my messuage and tenement with all land, grounds and appurtenances there unto belonging called Old Earth situated at Skelsmergh subject to the life estate therein of my dear wife Mary pursuant to our marriage settlement in trust that they sell the same at public auction or otherwise as soon as is convenient after the decease of my wife and from the proceeds pay the sum of two hundred and fifty pounds as directed by my wife pursuant to our settlement. And the remainder of the said proceeds to be equally given to my loving daughters Jane the wife of the said Robert LAWSON, Sibil ELLWOOD and Hannah the wife of Edward WALTON.
To my executors all my personal estate, goods and effects whatsoever in trust to discharge my just debts and funeral expenses, the expense of the probate of this my will and the legacies hereinafter mentioned.

To each of my grand children and great grandchildren as shall be living at the time of my decease one pound.

After paying my trustees for their expenses, trouble and loss of time besides the sum of ten shillings each which I give to them, the remainder of my personal estate to be equally divided amongst my three daughters Jane, Sibil and Hannah.
To my daughter Sibil I give my silver tankard and the remainder of my plate equally amongst my three daughters Elizabeth, Jane and Hannah.
To my four daughters equally amongst them all my household furniture and linen.



Francis ELLWOOD of Asby in the County of Westmorland, yeoman, of perfect mind.
Date of will 18 March 1801. Proved 21 Sept. 1803.
To my well beloved wife Margaret four pounds ten shillings every year during her natural life, being the interest of one hundred pounds now in the hands of John FAIRER.
The first payment on the first of January after my decease.
To my wife one clock, long table, new round table, one bedstead, bed and bedding, three chairs and what other things she brought with her at our marriage and whatever eatables shall happen to be in the house at my decease as meal, flour, flesh and so forth.
To my grandson William ELLWOOD all my freehold lands in the Manor of Asby Coatsforth known by the name of Bell Gards and Croft to him after the decease of his father, John ELLWOOD.
To my grandson, John ELLWOOD, fifty pounds six months after my decease, and fifty pounds more six months after my wife Margaret�s decease.
To my granddaughter Mary ELLWOOD fifty pounds six months after my decease, and fifty pounds more six months after my wife Margaret�s decease.
All the rest to my son John ELLWOOD, whom I appoint my only and sole Executor and I do hereby appoint John FAIRER to be my Executor in Trust to see my will duly executed with regard to my wife and grandchildren.

Will dated 7 March 1803. Proved 21 Sept. 1803.
To wife Ann ELLWOOD, three pounds, one cow, feather bed, bedding, bedstead and hangings round it that are in the upstairs room and for her to have the use only of the rest of my household furniture during her natural life and at her decease to go to my executors.
To nephew John ELLWOOD all my freehold land within the Manor of Dufton.
To niece Ann THORNBORROW, wife of Robert Thornborrow of Brampton Crofts Ends, �100.

All which I direct to be paid by my eldest son William when my youngest son Bernard attains the age of twenty one.
If my son John come by the decease of my eldest son into the possession of the estate which I now enjoy, the sum of twenty pounds above bequeathed to him shall be equally divided amongst his younger brothers and sister then surviving.

First I give and bequeath my soul to Almighty God and my body to be buried in the parish churchyard of Brough paying the �.tribute accustomed.
Item I give to my son in law Mychaell Brunskill and my daughter Julyan his wife five pounds which they owe unto me, upon condition that they, the said Mychaell and Julyan, shall presently after my decease make seal and deliver unto myne executrix��a good and lawful �of all other accounts debts and demands and �..my said executrix practably and quickly to occupy and enjoy my ground and housing now in my possession until the first day of May next after my decease. ITEM I give to my daughter Elizabeth Ewbank three puter (pewter) dishes her mother�s desk and a bible. In the name of God Amen. I Thomas Ewbank of Winton in the County of Westmorland, yeoman, being weak in body but of sound mind and memory, praised be God for the same, do make and ordain this my last will and testament in manner and form following. (That is to say) first and principally I commend my soul into the hands of Almighty God, trusting through the merits and intercession of my blessed lord and saviour Jesus Christ to obtain pardon of my sins and eternall (eternal) life and my body I commit to the earth to be decently buried at the discretion of my executrix here �ed. And as touching the disposition of all my temporall estate I give and dispose thereof as followeth.
First I will that all my debts and funerall expences be paid and discharged.
Also I give to my son and heir apparent Thomas Ewbank the sum of five shillings.
Also I give and bequeath to my sons Rowland Ewbank and Robert Ewbank and to my daughter Elizabeth the wife of William Mason all the household goods and household stuff and husbandry�equally among them, which belonged to me before my last marage (marriage) to be divided among them after my wife�s decease which said goods are particularly mentioned in a schedule.
Also I give and bequeath to my loveing wife all my new (or now) dwelling house with barn stable and cowhouse with garden and croft on the back side thereof to her sole use during her naturall life; and after her decease I give and bequeath the said dwelling house barn, stable and cowhouse with garden and croft with all their appurtenances unto my loving son Robert Ewbank to have and to hold the said dwelling house and premises to the said Robert Ewbank his heirs and assigns for ever. All the rest and residue (�and residue� repeated and crossed out) of my personal estate goods and chattels with the crop now growing on my land, I give and bequeath to my said loving wife Janneth Ewbank whom I do hereby make and appoint sole executrix of this my said last will and testament. Thomas baptised at Kirkby Stephen 27.May.1663 son of Thomas Ewbank and Agnes Waller (they married 19.May 1657). Thomas was about 73 when he made this will and died.
Thomas, the testator above, married first Ann Blaiklin 18 June 1691 at Kirkby Stephen. Before marrying Janneth (possibly Janneth Tunstall 22nd November 1730). Thomas is churchwarden of Winton in 1721. Robert who inherits above is the youngest son baptised 9th April 1707 at Kirkby Stephen. Robert Ewbank is in fact the ancestor of the Birstwith Ewbanks and the Wensleydale Ewbanks, a very large family to this day. Thomas the eldest son and heir apparent was baptised at Kirkby Stephen 23rd April 1696. Elizabeth the daughter was baptised at Kirkby Stephen in October 1697 and married William Mason on 18th September 1719 at KS. Rowland the other son was baptised 14th April 1703.

This is the last will and testament of me Edward Ewbank of Kirkby Stephen in the county of Westmoreland, yeoman. First I give and bequeath unto my niece Ann SUTHERLAND, wife of Mr Sutherland gardener of Penrith, in the county of Cumberland the sum of thirty pounds to be paid twelve months after my decease by my executor hereinafter named. Then I give and bequeath unto my (great) nephew Anthony MILNER of Bela Bridge in the parish of Brough and County of Westmoreland husbandman, son of my niece Elizabeth Milner all those two dwelling houses situate in Kirkby Stephen and county aforesaid; also I give and bequeath unto my said nephew Anthony Milner hereinbefore named all my household furniture, books, linen, cash, bonds and securities and all other effects��..

Whereas I Edward EWBANK of Kirkby Stephen in the county of Westmoreland yeoman have by my last will and testament bearing date the sixth day of February 1849 given and devised all my real estate(s?) situated at Kirkby Stephen and county aforesaid unto my nephew Anthony MILNER of Bela Bridge in the Parish of Brough and County of Westmoreland and whereas since the making and publishing this my said will now I do hereby give and devise to my niece Elizabeth MILNER, mother of my nephew Anthony Milner the sum of five pounds five shillings out of my real estates to be paid to her by two half yearly payments by my nephew Anthony Milner heretofore named, his heirs and assigns during the term of her natural life. And I order and direct that my said niece Elizabeth Milner shall not sell her income out of my said dwelling houses. And I also order and direct that my said nephew Anthony Milner shall not sell or mortgage the said dwelling houses during his mother�s lifetime. At her decease my nephew Anthony Milner hereinbefore named his full claim (?) power and authority of my real estates according to my former will. And I do hereby declare this present writing to be by me intended to be a codicil to my said will and testament. Also the same shall be deemed and taken as part thereof as fully and effectually to all and any purposes of the same��
