Richard EDMONDSON, Holme, parish of Burton, Westmorland, glover, 1768 Transcript marked �Extracted from the Registry of the Consistory Court at Lancaster within the Archdeanery of Richmond and Diocese of Chester� In the name of God amen I Richard EDMONDSON of Holme in the Parish of Burton in the County of Westmorland glover [being sick etc] declare this to be my last will and testament as followeth First I give unto my loving wife Maryan Edmondson the dwellinghouse wherein I now dwell being freehold situate at Holme aforesaid to hold for her natural life [with all rights etc] and after her death to my son Richard Edmondson chargeable with my wife and son paying out of the same one half of my debts and funeral expenses I give to my daughter Ann CLEMMY wife of Thomas Clemmy my Customary dwellinghouse [with all rights etc] holden under the Hon Frances CHARTERS Esq by the payment of rents fines & services therefore due according to the custom of the manner [sic] of Holme aforesaid chargeable with the payment of the other half of my debts [etc] and last I give to my wife Maryan all my personal estate [etc] and I appoint her my sole executrix. Added to the transcript is the following: On the 28th February 1782 administration with the will annexed of the goods of the said Richard Edmondson deceased was granted to Richard Edmondson and Ann Clemmy son and daughter of the deceased and devises named in the will Maryan Edmondson the executrix named in the will having departed this life in the lifetime of the testator. And Lancaster 15 February 1837 By desire of Mr Sharp I send you the annexed Office Copy the charges are 9/6. I have searched but do not find either will or admon of the other Mr Edmondson. Just debts and funeral and testamentary expenses to be paid. To my wife Jane all my stock in trade and such part of my household furniture as she elects to take within one month after my decease. All the rest of my personal estate to my sons Thomas Chamney ELLERAY and Stephen ELLERAY of Winster and to my sons in law Christopher STALKER and Roger FLEMING of Ambleside upon trust to sell and dispose of the same. The proceeds arising from such sale to be paid into the Banking House of Messr. Wakefield and Sons of Kendal at interest for purposes hereinafter described. To my trustees all my estate called Socald Tenement at Winster and all the other properties at Winster (except the two Cottages and orchard devised to my daughter Mary ELLERAY) with all their appurtenances and certain Moss Dales in Cartmel Mosses in Lancashire. My trustees shall deposit the rents and profits of the said properties into the banking House of Messrs. Wakefield & Sons upon trust that they, my trustees, shall in the first place pay an annuity of thirty pounds to my wife Jane during her life. The payments to be made in equal half yearly portions at May day and Matinmass day, the first payment to be made at the first of these days after my decease, the same to be taken and received by her in satisfaction of all dower and thirds she may be entitled to. After paying the said annuity and other payments hereinafter mentioned, when the fund accumulates to one thousand pounds I direct that my trustees shall pay the sum of two hundred pounds apiece to each of my daughters: Agnes the wife of Christopher STALKER, Mary ELLERAY, Margaret the wife of sd. Roger FLEMING, Isabella the wife of Robert MATTY of Liverpool, and Betsy the wife of Joseph STALKER of Keswick. After payment of the above legacies: To my son Thomas ELLERAY (charged with the payment of two hundred pounds in case my estate should have to pay off the two hundred pounds to John DIXON of Brundrigg to which I have become surety with my son Thomas) the dwelling house in Winster commonly called the Ancient Fire House with the out buildings, garden, orchard and appurtenances now occupied by my daughter Mary ELLERAY and my son Stephen and also all the buildings and offices therewith now in his, my said son Thomas�, occupation with the Orchard behind and adjoining the same Houses and all the parcels of ground situate at Winster called High Intack Middle Intack Wood Intack and the two fields called Grub Lands with croft ??? Field Well Meadow Pattys orchard Kelsick Meadow and orchard and also one half (the whole into two equal half parts to be divided between my son Thomas and my sons William and Stephen and the expense of fencing of the same to be paid by them in the like proportions) of the parcel of land called the Allotment which I have recently taken in from Winster Common and also all the rest of the Common or newly improved common lands which I have at Winster except the two acre field given to my sons Stephen and William below. To my sons William ELLERAY and Stephen ELLERAY during their lives and the longer liver of them (chargeable with the payment of one hundred and ninety pounds in case my estate should have to pay off one hundred pounds to John DIXON of Brundrigg and ninety pounds to my son in law Christopher STALKER for which sums I have become surety with my son Stephen) my Mill and the Malt kiln with the kitchen I some time ago erected and built into the house hereinbefore devised to my son Thomas and the gardens therewith in Winster and the closes of land called Mill How Ninevih Orchard Dam Meadow Peaselands Parrach near House End and also my dwelling house at the Head of Winster and all other out buildings and appurtenances garden and orchard as the same is now occupied by Isaac Swainton as Tenant and also the several Moss dales in ??thwaite and Lutherbarrow Moss in Lancashire and also all the newly taken in Field in my own possession which lies the highest up the side of the hill called Steal containing about two acres and also the other half of the parcel of ground called the Allotment. In case of the death of both my sons William and Stephen without lawful issue, the properties to be equally divided amongst the lawful issue of my sons John ELLERAY and Birket ELLERAY. To my daughter Mary ELLERAY my two cottages and orchard in Winster which were late the property of Charles BIRKETT. To my son Birkett ELLERAY two hundred pounds; fifty pounds to be paid within one year after my decease for his maintenance, fitting out and qualifications to practice as a Surgeon and the remainder to be paid as my wife sees fit; such sums to be paid out of the proceeds and accumulations of my real and personal estates. The money advanced to my son John ELLERAY shall be deemed to be an advancement and he shall not be accountable for the same to my Estate. My trustees may, with consent of my wife if living, advance to any of my daughters up to fifty pounds of their legacies providing that they or their husbands agree to pay interest on the advancement at the rate of four pounds per centum per annum from the advance thereof up to the time when they are to receive the whole of their respective legacies. I nominate Thomas Chamney ELLERAY, Stephen ELLERAY, Christopher STALKER and Roger FLEMING the Executors of this my will. In witness whereof I Birkett ELLERAY have to this my last will and testament contained in eight sheets of paper to the first second third fourth fifth sixth and seventh sheets thereof set and subscribed my name and to the eighth and last sheet hereof my name and seal this sixteenth day of February one thousand eight hundred and twenty eight. WALTON, Jane RIGG Whereas I Birkett ELLERAY of Ambleside in the county of Westmorland, yeoman made and executed my last will and testament dated sixteenth day of February one thousand eight hundred and twenty eight and I now make this as a codicil to be annexed thereto and to form part thereof. Whereas I devised to my daughter Mary ELLERAY my two cottages and orchard at Winster I now direct that the same be conveyed to her when the other legacies become payable. In the mean time the rents thereof to be added to the value of my Estate. I authorise my Trustees to extend the advance of fifty pounds to the different legatees applying for the same to the sum of seventy pounds upon the terms as mentioned in the will. I revoke the devise of the Peat Moss and Dales and now devise the same in equal moieties between Thomas and Stephen and William. Thomas to take one half and Stephen and William the other half.
