The Commonwealth of Virginia, (Plaintiff) against
William Barker (Defendant)
On an Indictment
THIS day came as Well the attorney of the said Commonwealth as the
defendant in his proper person and thereupon came also a Jury To wit
Samuel Montgomery, David Gatgood, Jacob Mungle, Thomas Montgomery, John
Beatie, Samuel Magee, Benjamin Sharp, Robert Faires, Robert Richards,
Archelaus Brumley, George Berry and Gilbert Watson who being
elected tried and sworn the truth to speak upon the issue joined upon
their Oaths do say that the defendant is guilty in manner and form as in
the Indictment against him is alledged. Therefore it is considered by
the Court that the said defendant make his fine with the said
Commonwealth by the payment of five pounds to the use of the said
Commonwealth and that he pay the Costs of this prosecution and mat be
taken & c. Costs two hundred and twenty pounds of neat Tobacco and
fifteen shillings Attornies fees. |

In the name of God, Amen. That I Samuel Henry of Washington County,
Virginia being weak in body but of sound memory and Judgment blessed be
God for all his mercies Calling to mind the mortality of the body and
that it is appointed for all men once to die do recommend my soul to God
who gave it & my body to be buried in a decent Christian manner at the
discretion of my Executors and as for what worldly Estate goods and
Chattels it has pleased God to bless one with in this life at this time
I do order and bequeath in following manner; and first I order that the
Land I bought from Archibald Maginnis be sold at the discretion of my
Executors and my other effects that can be spared, and all my lawful
debts to be paid. I leave and bequeath to my beloved wife Elizabeth the
thirds of the plantation I live on and the third of the plantation I
bought from George Berry, during her widowhood and in she marries
her third part afterwards to be valued by men what it is to be, and her
to be paid what is just and one Cow and year old heifer her choice, the
black horse & her saddle & bridle one bed and furniture the dresser
furniture her own pot and little Over her wheels & Reel and one Chest
and two Sheep her choice. I leave and bequeath to my two sons Robert and
Charles to them their heirs and assigns the plantation I bought from
George Berry equal chares according to Quantity and Quality and the
plantation I now live on I leave to my son James to his heirs and
assigns. I leave to my three daughters Mary, Sarah and Jean a ten pound
horse saddle and bridle and a Cow to each of them to be paid as follows
(to wit) Robert to pay Mary, Charles to pay Sarah and James to pay Jean
two years after said Robert, Charles and James are come of age and if it
should be that another lawful heir should appear I desire allow and
appoint James Henry my brother, James Berry Robert Kinhead and my
beloved wife Elizabeth to make it an equal share which my sons Robert
Charles and James are to pay when it comes to age, and I further allow
that my children be raised Schooled and cloathed out of my personal
Estate and if it should be that any of my heirs should die under age I
allow that their share shall fall to the other of the same sex females
to females the Males to the Males and further I allow my brother James
Henry, James Berry, Robert Kinkead and my beloved wife Elizabeth to
Execute this my last Will and I do hereby revoke & disannul all other
Wills & Testaments and Testament and do Ratify and confirm this to be my
Last Will and Testament. In Witness my hand and seal this twenty fourth
day of April one thousand seven hundred and Eight six.

In the name of god amen, the sixteenth of December one thousand seven
hundred and ninety eight. I, Thomas Berry, of the County of Washington
and State of Virginia, being weak in body but sound in mind and knowing
that all flesh must yield to death when it shall please god to call, I
do hereby make constitute and ordain and declare this to be my last Will
and Testament in manner and form following revolking and anuling by
these present all and every testement or testaments will or wills
heretofore by me made and declare either by word or writing and this to
be taken only for my last will and testament and none other and now for
the settling my temperate estate and such goods and chattals and debts
as it pleased god for above my deserts to bestow on me. I do order, give
and dispose the same in manner and form following, And first I do will
that all my just debts be paid within convenient time after my decease
by my executors hereafter named and seconded, I do give and bequeath to
my well beloved wife Esther the third part of all the moveable Estate
except the negros as I have left her the third part of the price of my
land already. I do leave to my son George a negro named Adam and
all my wearing apparel and George is to give to my daughter
Rebeckah fifty dollars. I do also leave to my daughter Esther a negro
girl named Phili to her and her heirs and if the girl has any children
they are to go to Esther and her heirs, also my negro woman named Tawney
I do allow her to be free and I leave her a milch cow. I also leave to
my son John, four dollars. I also leave the rest of my estate to my
children hereafter named, son James, son Thomas, my daughter in law Mary
Berry, wife to son William deceased, my daughter Mary, my daughter
Barbara, daughter Rebeckah, my daughter Elizabeth, my daughter Susannah,
my son Francis to be equally divided among them. I also leave to my
grandson Thomas Dryden my best saddle. I also will that David Dryden and
Samuel McChesney and David Lowry shall be my Executors given under my
hand and seal this sixteenth of December 1798.

To all to whom these presents shall come, Greetings. Know ye that in
pursuance of an act of the General Assembly passed on the twenty third
day of November Eighteen hundred and nine there is granted by the said
state of Tennessee unto George Berry a certain tract or parcel of
land containing three hundred and fifty one acres, within the tract
located for the one of academies lying in the county of Blount in the
District South of French Broad and Holston on Crooked Creek, there being
due and chargeable on said land the sum of three hundred and fifty one
Dollars with the Interest due thereon.
Beginning at a stake thence with the Heirs of William Glass, South
seventy nine degrees thirty minutes East forty nine chains and nineteen
links to a Black Oak, East sixteen chains and twenty seven links to a
stake, South forty six East thirteen chains and thirty links to a white
oak, North fifty two degrees thirty minutes East eleven chains and
twenty nine links to a stake, South eighty four degrees fifteen minutes
East Sixty two chains and forty two links to a black oak, South seventy
one East eleven chains and twenty three links to a hickory, then with
John McClary North thirty East thirteen chains and nine links to an elm,
North thirty six West eight chains to a post oak, North twenty East nine
chains and forty four links to a post oak saplin, North fifty degrees
thirty minutes East forty two chains and forty six links to a post oak,
Then with Charles and William Gagain, Senr. North sixty one West
thirteen chains and fifteen links to a hickory, North eight degrees
fifteed minutes West twenty five chains and thirty two links to a white
oak, North thirty three West five chains to the creek, then with the
same thirteen chains and forty links, then South sixty West crossing the
creek one chain and forty two links to an elm, then with the creek and
the heirs of William Scott, North fourteen West thirty five chains and
thirty two links to a stake, South eighty six degrees fifteen minutes
West twenty nine chains and thirty two links to a hickory saplin, then
with vacant land, South thirty six West seventy two chains to a Black
Gum, North fifty five West thirteen chains and twenty links to a hickory
saplin, South thirty seven West twenty two chains to a post oak, South
forty one East seventeen chains and twenty three links to the Beginning.
Surveyed March the thirteenth Eighteen hundred and seven. With its
appurtenances.
To Have and To Hold the said tract or parcel of land with its
appurtenances to the said George Berry and his heirs and assigns
forever. In witness whereof Willie Blount, Governor of the state of
Tennessee hath hereunto set his hand and caused the great seal of the
said state to be affixed at Knoxville on this the twenty second day of

In the name of God Amen I George Berry of the State of Tennessee
Blount County, Calling to mind that all men have to die and being in a
low state of health, though in perfect mind and memory do on this Third
day of January one thousand eight hundred and twenty nine make and
ordain this my last will and desire as follows, Viz:
1st. It is my request that all my just debts shall be paid of by my
executors out of that part of my property that my wife and family can
best spare, and of such articles as they may think proper to dispose of.
2nd. It is my wish and desire for my beloved wife Elizabeth Berry
to have all my house hold and kitchen furniture to will and dispose of
in what way and manner that she may think proper. I also give her one
milk Cow and Calf just which she may think proper to take, one Roan mare
known by the name of Mage.
3rd. It is my wish and desire for my wife and family to live together as
long as she lives and they all are so minded to stay with her and keep
all of my property together for the use of the family. And at her death
for the property left to her for that purpose to her subject to the
distribution
among my children and Grand Children (only such articles as I shall give
to my children hereafter which I shall not include as the common Stock
on my farm). I wish it to be subject to eleven shares.
4th. That part of my stock of horses owned by my daughter Hettie Berry I
disown and acknowledge them to be her property Viz: one Sorell Mare
known by the name of Nell, one rone horse known by the name of Ben and
one half of the Chestnut colt known by the name of Doctor. Also that
part of my stock of Cows owned by my daugher Peggy Berry I disown Viz:
one stear one year old, one cow, and two Calves and I herby acknowledge
them to be the property of the aforesaid Peggy Berry.
5th. It is my desire that on my wifes death that one share of my
property shall be equally divided between my two Grand children know by
the names as follows. Viz: one half to go to George B. Keys and the
other half to James Cummings.
6th. It is also my wish that at my wifes death for one share to be
divided as follows viz. I wish my Grand Son George B. Thomson to have
one half of said eleven shares and my two grand daughters Elizabeth &
Isabella Cummings to have the other half of said shares.
7th. It is my request for my Executors to furnish my daughers Ibby Berry
with one side Saddle worth twenty five dollars out of the common Stock
of my property; I also give her out of my stock of cattle one cow and
calf.
8th. I also wish and desire for my daughters to be furnished with one
cow and calf (if any Calves) whose names are here asserted vis: Hetty
Berry, Sally Berry, Peggy Berry and Ann Berry.
9th. It is also my wish and desire for my son Thomas Berry to have the
other half of the Colt owned by Hetty Berry.
10th. It is my wish and desire at the death of my wife Eliz. Berry
for each one of my children to have a share of the common stock left on
hand whereas names will follow Viz: Hettie Berry, Sallie Berry, Rebecca
Cummings, Thomas Berry, Peggy Berry, Ann Berry, Darky Gamble and Ibby
Berry.
11th. I do hereby appoint my true and trusted friend John Lowery and
Andy Cowan my Executors to this my last will and testament given from
under my hand and seal day and date first above written.
