"Buried after 17 Oct 1840 in Fort Gibson, Muskogee, OK. His grave and tomb is the only one located on the lot maintained by the Oklahoma Historical Society, which was donated to them by Jesse B. Milam, who was the principal chief of the Cherokees from 1941 until his death in 1949. John MARTIN was 1/8 Cherokee Indian blood. His wives, Eleanor Nellie MCDANIEL b. 1793; d. 25 Sept. 1849; AND Lucy MCDANIEL b.About 1791; d 25 Sept 1860; both were 1/8 Cherokee blood and and sisters. He built each one of his wives a nice large home. For Lucy, he built a home beside the Salquary River in Murphy County, Georgia. The home for Eleanor Nellie McDaniel had a house fifteen miles away beside the Coosawatee River in Murphy County, Georgia. He lived with both wives and had a large family by each one. John Martin was elected 12 November 1835 as one of the Commissioners to "lay out" the town of New Echota, Capitol of the Cherokee Nation, East. He was a signer of the treaties of 8 July 1817 and 27 February 1819. In 1819 he was elected the first Treasurer of the Cherokee Nation. He was elected the first Supreme Judge (Chief Justice) of the Cherokee Nation in 1821".

He was elected November 12, 1835, as one of the Commissioners to ''lay off'' the town of New Echota, Capitol of the Cherokee Nation, East. He was a signer of the treaties of July 8, 1817, and February 27, 1819. He was elected Treasurer of the Cherokee Nation in 1819. Was elected Supreme Judge of the Cherokee Nation in 1821. He was a member of the Constitutional Convention of July 26, 1827, from Coosawaytee District. He died October 17, 1840. Lucy Martin nee McDaniel died September 25, 1860. [Editor's Note: It appears that the father of John Martin was John ''Jack'' Martin, the brother of Joseph Martin, rather than Joseph Martin. Several letters were written in 1831 to Gov. George R. Gilmer of Georgia in response to his queries regarding the white ancestry of many of the Cherokee leaders. At least two of the letters state that John Martin's father was John or Jack Martin, the brother of Joseph Martin. These letters have been published in Whites Among the Cherokees, collected and edited by Mary B. Warren and Eve B. Weeks, Heritage Papers, Danielsville, GA 30633, in 1987.

"John Martin was the first Chief Justice of the Cherokee Nation and was one of the writers of the Cherokee national constitution.

Attached to a copy of the 1906 application for Andromache Shelton nee Bell I found a page listing the children of John Martin and his wives, Nellie and Lucy McDaniel, and a letter by his grand-daughter. Eugenie Madeline Shelton...

"...John Martin, my maternal grand father, had two wives - sisters - Nelly and Lucy McDaniel - from whom were born to him eight children each - besides - he had one child, Amelia or Milly as she was usually called, whose mother was a Matoy - these Matoy's were old settlers or western Cherokees and her name may not appear on the roll of 1851 of emigrants - she [Amelia] died childless...""
