Sylvester Joseph Emanuel was also known as Silvester Emanuel.3 He was born on 14 October 1840 at 146 Rosemary Lane, Wapping, London, England; and his birth was recorded at Whitechapel Registration district in the December quarter 1840.4,1,3,5,6,7 He recorded as having early faith affiliation with Hambro Synagogue.6,7 He was the son of Joseph Emanuel and Jane Lazarus.1 Sylvester Joseph Emanuel appeared on the census of 6 June 1841 at Petticoat Lane, Aldgate, London, England, as Silvester Emanuel, age 7 months, birthplace Middlesex.4 He appeared on the census of 30 March 1851 at Whitechapel, London, England, as Son, age 15 (or ?), birthplace Middlesex, and he was a Scholar.8 He emigrated in 1859 from London, England; to Australia.7,6 He the Bendigo Advertiser reported: 'A SERIOUS CHARGE.-Michael Barrow, who had been remanded on a charge of violently assaulting Sylvester Joseph Emanuel, was brought up. Sergeant Drought stated that, the prisoner had, when previously charged, been let out on bail; but had been re-arrested on the previous night, in consequence of the dangerous state of the prosecutor. It had been found requisite to have the prosecutor's dying depositions taken that morning before the Police Magistrate, as the doctor had given an opinion that he could not live many hours. The Bench remanded him for a week, or, in the event of tho prosecutor's death, to be brought lip before the Coroner.' on 31 July 1860.9 He died on 3 August 1860 at Junction Bendigo, Victoria, Australia, at age 19; and he died 'as the result of a fight - assailant convicted of manslaughter'. Cause of death 'phrenitis from severe skull injuries/manslaughter.10,7,11' He was buried; according to a report in the Bendigo Advertiser of 6 August 1860:

'THE ASSAULT AT VIEW POINT.

'The District Coroner empanelled a jury on Saturday, at the Shamrock Hotel, to inquire into the circumstances of the death of Sylvester Joseph Emanuel. After the jury had been sworn, they proceeded to view the body, and on their return, the Coroner, after a few brief remarks, adjourned the case to Tuesday next, 7th August, at eleven o'clock.

'In the afternoon a post mortem examination was made, performed by Dr. Hunt, in the presence of Drs. Boyd, Landvoight, Cruickshanks, Atkinson, Burnett, and Dow. It would appear that there had been inflammatory action of the membranes of the brain, causing suppuration. The depressed bones seemed to have been raised very neatly and placed in position, and all seemed to have been done that surgical aid could do.

'On Sunday afternoon the deceased was conveyed to his last resting place, at the White Hills Cemetery, A large and respectable number of members of his persuasion followed him to the grave.'

According to a further report in the Bendigo Advertiser of 8 August 1860:

'THE LATE FATAL ASSAULT AT VIEW POINT.

'The adjourned inquiry info the circumstances connected with the death of Sylvester Joseph Emanuel, was resumed yesterday at the Shamrock Hotel, before the District Coroner and a special jury. The following is the jury impannnelled:- W. C. Tully (foreman), W. Heffman, James Taylor, J. N. Macariney, P. Guttteridge, G. P. Joseph, Edmund Huxtable, Edward Ryan, John Davis, W. M. Bennett, - Cohen, and W. Crawshaw.

'The prisoner, Michael Barrow, was present in custody during the inquiry. Mr. O'Loughlin appeared in his behalf. The following evidence was adduced:-

'John Schleger, cellarman at Abbott's Hotel, deposed that he was in the bar below on the night of last Tuesday week. The deceased and prisoner were playing billiards together. He saw them both go outside into the yard, when he heard them quarrelling together. A short time afterwards deceased returned to the cellar, holding a handkerchief to his nose, which was bleeding. Prisoner came in afterwards. Witness heard deceased say to prisoner "It is not fair play to strike me. If you want to fight I'll fight you."
They were quarrelling and prisoner would not pay for his game, as he had not finished. They quarrelled, and prisoner took up a gingerbeer bottle and threw it at deceased. It did not hit him, and prisoner then took up a cue, but was prevented from striking deceased by a man named Hollier and another named Marney; Shortly after they did so, deceased said, to prisoner, " If you don't like to fight, then take that," slapping the prisoner's face. The men that were playing bagatelle then came up and wanted to fight, tho deceased. The deceased, these two players, and the prisoner then commenced quarrelling. Witness closed the bar at twelve o'clock. Witness advised deceased, while prisoner was standing by, not to go home, but to go into witness's room. He did so, as the prisoner was looking very wild. Witness said he forgot to mention that after deceased gave prisoner the slap in the face, the latter said, " Wait till I get you alone ; I'll give you a good mark." Deceased would not take his advice about staying, but shortly afterwards he went, but, followed by prisoner, in a great hurry. Deceased was quite sober when he left. Believes the prisoner was also sober. He had frequently before seen the deceased and prisoner together in the cellar, but never saw them quarrelling.

'By Mr. O'Loughlin: It. was after deceased and prisoner went out into the yard that he heard the quarreling!ling. He didn't hear Emanuel say any-thing before he threw the gingerbeer bottle at him. Emanuel did nothing when it was thrown at him. He did not pay such particular attention to what Emanuel did, as he had to pay attention to his business. It was after prisoner took the cue, that deceased struck prisoner in the face. Prisoner did not strike deceased with the cue, as he was prevented by the men standing by. For all witness knew prisoner might have gone home instead of following deceased, when he went out. He did not see that prisoner had a black eye after he was struck by deceased.

'Lachlan O'Loughlin, Police Magistrate of the Sandhurst District, produced the dying deposition of the deceased, taken on the morning of the 30th July. Before taking his deposition, witness asked him if he was aware of his condition; to which question deceased replied he had no hope of recovery that he knew he was on the brink of the grave. Deceased appeared to have all his faculties clear and unimpaired. The prisoner was then brought into the room, when deceased said he knew him, and that his name was Barrow. He then made the declaration.

'Before the declaration was read, Mr. O'Loughlin objected that the declaration was not evidence, as it was signed by the mark of the deponent; and it was not stated on the deposition that it bad been read over to him.

'The Coroner would allow the objection if Mr. O'Loughlin could show him any legal authority on the subject.

'Mr. O'Loughlin said he would be prepared with the authority before it was given to the jury in evidence. - In answer to the Coroner, the Police Magistrate said it had been read over to deceased before he signed it.

'Mr. O'Loughlin said, as he could not find any authority at present on the subject, he would not further object.

'The dying deposition was then read as follows:

'The dying declaration of Sylvester Joseph Emanuel, taken in the presence of the prisoner, Michael Barrow, by Lachlan O'Loughlin, Esq., Police Magistrate for the district of Sandhurst, on the 30th July, 1860 :-" My name is Sylvester Joseph Emanuel; I am a billiard marker at Abbott's ; I know Michael Barrow; that is him that I now see standing before me; on Tuesday evening, the 24th day of July, about half past eleven o'clock at night, I was in the bagatelle room of Abbott's Hotel; I saw Michael Barrow there, and we commenced playing a game at billiards ; he called me a sharper while at play; he then said he wanted to go up stairs to make water; I followed him into the yard; at this time he was making water; he then said, ' If you won't take the law of me I would strike you on the nose he then struck me a blow on the nose, which bled it; I struck him in return, and we commenced to fight; some parties present separated us ; Michael Barrow then called me a b y liar; we then both returned to the billiard room, and he seized a cue, and attempted to strike me; he was prevented by someone; before attempting to strike me with the cue, he threw a ginger beer bottle at my head, but missed me; I struck him a blow in the eye after we returned to the billiard room; that was because he called me a b---y liar ; it was then about 12 o'clock ; I left the billiard room to go home; the prisoner followed: when I came opposite Dr Boyd's I heard Michael Barrow say, 'Stop a minute I want to speak to you ; I turned round, and saw Michael Barrow standing behind me at a distance of 5 or 6 yards; I saw him raise his hand he threw a stone, which came close to my head, but missed me; in avoiding this stone my hat fell off; I was in a stooping position then; he was at this time within two or three yards of me: he threw a second stone at me; I was bareheaded at this time; it struck me on the side of the head, and I fell senseless; I came to my senses, and after trying four different times I succeeded in crawling on my hands and knees to Dr Boyd's shop; prisoner was gone at this time ; I rang the bell and got in, and Dr Boyd examined my head; I was perfectly sober; prisoner was also sober. I make this declaration believing myself to be in a dying state, and firmly believing that I cannot recover. Signed, SYLVESTER JOSEPH EMANUEL, his X mark. Witness, Wm G DROUGHT, H P. 51, Sergeant of Police. Declared before me at Sandhurst, this 30th day of July, 1860 LACHLAN O'LOUGHLIN, P.M."

'Eli Hellier, the keeper of the bowling alley at Abbott's Hotel, was in the cellar on the night in question, when hearing a row in the yard, he went up, and found deceased and prisoner quarrelling. Witness saw that deceased was bleeding in the face. He heard prisoner ask deceased to come into Market Square and fight. Deceased said he did not want to take advantage of prisoner. Witness parted them and persuaded deceased, to come below and have no row. After the deceased and prisoner came again into the Cellar, witness heard some angry words between them. The rest of witness's evidence was generally corroborative of the former witness's testimony in reference to what took place in the cellar before the prisoner and deceased went away......2'
