No other neighbors named. The deed was witnessed by W.H. Miller and John Eastridge..5 |

The land was described as "beginning on a white oak running north 50 degrees east 97 poles to a double chesnut, thence north 47 west 19 poles to a stake a division corner of H.R. McMillan and J.A. Johnson, thence north 87 west a division line 82 poles to a stake in the line of another tract thence south 13.5 degrees east 81 poles to the beginning, including 24 acres." Now J.A. Johnson was Sarah Elizabeth's brother Alexander, and S.S. Johnson I believe was Sarah Elizabeth's mother Sophina Johnson. Two days later, the McMillans bought 24 acres FROM J.A. Johnson for the same price, so it looks like the siblings traded shares of their mother's land, or else these deeds are the method by which they split up their mother's land..8 |

On 5 July 1885, at Ashe County, NC,, Polly A. McMillan applied for a widow's pension under an 1885 pension act, giving her age as 51 and her residence as Ore Knob. She stated that she was the widow of William McMillan of Company A, 26th Regiment, who enisted on or about the 15th of April 1861 and that "while in performance of duty in said company and regiment in the state of North Carolina on or about 23rd day of November 1864 he died of disease contracted while in said service." The application was normally a pre-printed form with blanks to fill in for the name of the widow and soldier and relevant dates, but this was a hand-written paper using the same wording as the printed form. She had to swear that she held no office for which she received at least $300 in fees or salary, that she did not own property worth more than $500, and that she had not remarried. L.S. James of Nathan's Creek swore that she was "the person she represents herself to be."

On 24 June 1901, at Ashe County, NC,, Polly A. McMillan applied for a widow's pension under a 1901 pension act, giving her age as 70 and her residence as Gale. She stated that she was the widow of William McMillan of Company A, 26th Regiment, who enisted on or about the 17th of May 1861 and "returned from the war afflicted with scrofula, from the effects of which he died within a very short time after his return, in the spring of 1865." The application was a pre-printed form with blanks to fill in for the name of the widow and soldier and relevant dates. No other genealogical information was given. She had to swear that she held no office for which she received at least $300 in fees or salary, that she did not own property worth more than $500 nor disposed of property of such worth since March 11, 1885, and that she had married the soldier before April 1, 1865 and had not remarried. This form called for a "Physician's Certificate," in which J.W. Colvard of Jefferson and S.A. James of Crumpler swore that she was "the person she represents herself to be.".15 |

In the Eleanor Baker Reeves collection at the Ashe County Public Library, in the McMillan folder, was a 2-page photocopied handwritten document titled "Family record." Unfortunately, Mrs. Reeves did not note on the document where she got it. It is written mostly in one handwriting, with death dates written in a different hand.
The text of the document is as follows:

[The 1851 is written in the second handwriting. I don't know if the original left out the date or it was faint and the second writer made it clear.] Aug 14, 1905 [written under her name in the second hand.] Hardin Radalphus McMillan borned January 18, 1853 Nellie Adeline McMillan was borned March 5, 1855 Sarry Lutishia McMillan was borned May 8, 1857 Jessie Council McMillan was borned May 29, 1864 Mary Alice McMillan was borned June 15, 1869 June 14, 1905 [written under her name in the second hand] Bettie McMillan were borned May 29, 1870 Arthur Hardin McMillan borned March 23, 1879 John Robert McMillan was borned July 28, 1873 [beside his name was written Jennie, in the second hand, and under it was Deceased April 23, 1879 James Franklin McMillan were borned Nov 11th, 1876 Deceased May 26, 1903 [in the other handwriting] Note that these children continued after William's death. It is unclear who the parents of the last 5 are. I believe they belong to Mahala Jane. (In the 1900 census a Betty Sturgill born in May 1870 had in her household Jackson Noblett, step father, and Jane Noblett, born March 1851, mother. A Bettie McMillan married Jesse Sturgill in Ashe Co in 1892.) I'm trying to decide who wrote this. If the names were written as each was born then John who was age 7/12 in the 1860 census would have been listed. It must have been written by one of the younger children who was not alive when John was born, maybe even one of Mahala Jane's children. The second handwriting, which filled in the death dates, couldn't have been Mrs. Reeves, because no dates are filled in after 1905.7

On 14 November 1856, at Ashe County, NC,, William McMillan signed a deed of trust to John Ross. The wording was as follows: " This indenture made this day between William McMillan of the first part and Caswell Halsey [his brother-in-law] of the second part and John Ross of the third part, all of the county of Ashe and State of North Carolina. Witnesseth that whereas William McMillan is justly indebted unto Caswell Halsey in the sum of five hundred dollars and is desirous to secure him for said debt and in trust thereon for the consideration of the sum of one dollar in hand paid for that purpose hath bargained and sold unto him the said John Ross five head of horses and two colts that the said McMillan now has in possession one yoke of steers all his stock of cattle one road wagon and harness, hogs and sheep all that said McMillan owns one set of blacksmith tools all his corn hay and oats one cubbboard one ?burian one black and ? table to be his right and property in special trust and confidence that is to say that the said McMillan is to have the use of said property from this day until the 14th day of March next provided he takes good care of the same and it is further agreed to by all the parties to this indenture that if the said Wm McMillan do not pay off and discharge the said five hundred dollars and its lawful interest on or before the 14th day of March next then it shall be the duty of the said Jno Ross he having been requested so to do by the said Caswell Halsey to advertise all the above named property at least eighteen days at three public places in said county to proceed to sell said property at the dwelling house where William McMillan now lives to the highest bidder for ready money then pay and discharge the said debt of five hundred dollars and its lawful interest and the cost and commission of this trust and the said John Ross shall well and truly pay over the overplus if any to the said McMillan or his lawful representatives." This was the year after the death of William's father. Perhaps he was borowing this money from Halsey while he awaited the settlement of his father's estate. He was left only land and slaves. I can find no record of his having sold land, but he could have sold one of the slaves to pay this debt..11 |

On 5 July 1885, at Ashe County, NC,, Polly A. McMillan applied for a widow's pension under an 1885 pension act, giving her age as 51 and her residence as Ore Knob. She stated that she was the widow of William McMillan of Company A, 26th Regiment, who enisted on or about the 15th of April 1861 and that "while in performance of duty in said company and regiment in the state of North Carolina on or about 23rd day of November 1864 he died of disease contracted while in said service." The application was normally a pre-printed form with blanks to fill in for the name of the widow and soldier and relevant dates, but this was a hand-written paper using the same wording as the printed form. She had to swear that she held no office for which she received at least $300 in fees or salary, that she did not own property worth more than $500, and that she had not remarried. L.S. James of Nathan's Creek swore that she was "the person she represents herself to be."
I cannot explain why Polly's age and William's date of death are incorrect on this..14 |

On 24 June 1901, at Ashe County, NC,, Polly A. McMillan applied for a widow's pension under a 1901 pension act, giving her age as 70 and her residence as Gale. She stated that she was the widow of William McMillan of Company A, 26th Regiment, who enisted on or about the 17th of May 1861 and "returned from the war afflicted with scrofula, from the effects of which he died within a very short time after his return, in the spring of 1865." The application was a pre-printed form with blanks to fill in for the name of the widow and soldier and relevant dates. No other genealogical information was given. She had to swear that she held no office for which she received at least $300 in fees or salary, that she did not own property worth more than $500 nor disposed of property of such worth since March 11, 1885, and that she had married the soldier before April 1, 1865 and had not remarried. This form called for a "Physician's Certificate," in which J.W. Colvard of Jefferson and S.A. James of Crumpler swore that she was "the person she represents herself to be.".15 |

Maxwell's District, having 800 acres of land valued at $400, with 3 polls (I believe a 21 year old free male or a slave was worth one poll) Two names from him is Jas McMillan with 400 acres valued at $100 and no polls (meaning he was under 21, although I don't think that's correct). Next to James is Jno McMillan, Jr with 400 acres valued at $100, also no polls. Over in Captain Weaver's District was Andrew McMillion with 550 acres valued at $400 and 1 poll, beside his name it says Nathan's Creek. These tracts of land on which the sons were living may have belonged to their father. As far as I know, 1815 is the only early tax list for Ashe County to have survived..4 |

John McMillan left a will on 13 August 1855 at Ashe County, NC. In the name of God Amen, I John McMillan of the county of Ashe and state of North Carolina feeling weak in body and knowing that all men must die, and after death to judgment when all mankind must give an account for the deeds done in the body. And as for my property, both real and personal, my will is as follows. I bequeath and give to my son William McMillan the land where he lives known as the James McMillan tract. It is to be divided from the tract that I now live on in the following manner to begin at the mouth of a small branch called the Middle branch that runs into the Piney fork near the old Wm Baldwin house place and south of Jas B Parsons south east corner thence on the west side of the old Coots field fence so as to include said old field then with the fence to the wagon road then to the old ridge or orchard field on Baker Ridge known as the Wm Baldwin place to include said field then East to A.B. McMillan's land and with his lines and William Hanes and Moses Dixons lines to the first station. It being the land that my father willed to James McMillan's sons. The home place and all my adjoining lands I give to my son John McMillan with the following reservations, that is to say. My beloved wife is to have the houses and out houses and her dower in the home tract of land during her life. I also will to her forever the tract of land on the south fork of New River containing about two hundred acres it being the land I purchased of T. Witcher. She is to sell or dispose of it as she think proper. She is to have ten choice cows, sheep and hogs, half of what I now have or had. Also my yoke of oxen, (my black smiths tools her life time). I give my wife two horses named doll and dove, all my household and kitchen furniture and I give my wife three negroes her choice during her life. I give to William McMillan my negro boy Simon and one half of a boy named Lee and to my son John McMillan I give the Negro boy Sam and to my daughter Adaline I give the negro boy Alfred to my daughter Polly Dickson I give her a note that I hold on Enoch Reeves, that he gave me for negro girl that I sold to him. My daughter Nancy that married Noah Baldwin being dead and having left no heirs and what property that I gave him after marriage he may keep but he is not to have any more of my estate and the note that I have on Noah Baldwin he is to pay it to my estate or heirs. To my daughter Jane I give a small negro girl named Ann. The balance of my property not willed away is to be sold and all my debts collected and all my debts is to be paid and any money remaining on hand to be divided among my daughters so as to make them equal except Cindy Cavender. The property that I give my two sons is to be all that they are to have. The land that I purchased in Grayson County known as the Ed Parsons tract Caswell Halsey is to have the land on the west side of the waggon road at its value and if he can pay for all of the said tract he may have it. If not the residue is to be sold and the money divided among my daughters as above mentioned with the above exceptions. I give to my daughter Jane a mare that she claims to be her property. I constitute and appoint Alexr B. McMillan my executor to execute this my last will and testament. Revoking all other wills and testaments. On 7 January 1860, at Alleghany County, NC,, The commissioners appointed to settle with A.B. McMillan, executor of John McMillan, deceased, made their report that sales of personal property "including negores" brought in $4807.32, sale of land to Caswell Halsey brought in $1690, recovery of debts owed to the estate brought in 3627.84, for a total estate of over $10,000. Vouchers for amounts paid out, plus commission and fees amounted to 3474.38, so the amount to be paid to heirs was $6680.78, to be divided by six. [The will clearly stated that the land was all the sons were to get and the money was to be divided among the daughters, so I believe this means there were 6 living daughters, not counting Cindy, who was excepted. The will mentioned Jane, Adaline, and Polly plus Caswell Halsey, husband of Mahala. Matilda Dickson bought one of the slaves at the sale, so that's five daughters. I have 3 family group sheets from experienced reearchers of this family, and they all 3 have Irena as a daughter, so I'm supposing they have access to family information I don't have and she's the sixth daughter. (They also all have Matilda and two have Mahala). The final settlement of the estate took place in Alleghany County, which was created from the eastern part of Ashe County in 1859.].11 |
