"John Garnett and Elizabeth Rogers, his wife, lived in Culpeper Co., Va., at or near Mount Pony, prior to and until about the year 1786. His son, Richard Garnett, was born in Culpeper County November 10, 1775. About the year 1788, John Garnett and his family moved to Scott Co., KY, but soon after moved to Green Co., KY, and a few years thereafter settled in Barren Co., KY."

1782 Personal Property Tax List of Culpeper County. John Garnett is listed with 1 white tithable (male over 21), 6 slaves (names: Rich, Sue, Sue, Ester, Ben, and William), 9 horses, and 14 cattle. He paid taxes of 4 pounds, 11 shillings, and 6 pence.


A deed dated July 16, 1784 in Culpeper County (Deed Book M, page 221). "Deed by Stigler and wife to John Garnett of County of Culpeper, conveying 400 acres in Culpeper Co., North side of Matapony (Mount Pony?) Mountain, also 9 acres, also 39 acres." Mount Pony Mountain is just south of the City of Culpeper.


From the 1786 Personal Property Tax List of Culpeper County: John Garnett is listed with 1 white male over 21, 3 slaves over 16, 3 slaves under 16, 4 horses, 6 cattle, 4 number of heads tythable, and paid a tax of 3 pounds, 19 shillings, and 6 pence.


A deed dated December 1, 1787 in Culpeper County (Deed Book L, page 236). "Deed by John Garnett and Betty, his wife, of Culpeper Co., to Legg, conveying 545 acres in Parish of St. Mark, Culpeper County."


1789 Culpeper Personal Property Tax List: On May 6, John Garnett is listed with 1 white male over 21, 0 slaves, 2 horses, 1 tithable, and paid a tax of 4 shillings.


This may be another John, possibly his son, although he should have only been 16, or it could be property that John still had remaining in Culpeper.

Will: I, Richard C. Gilliam, of the County of Buckingham, and State of Virginia, do make this my last will and testament in manner and for following, To-wit:


I direct that my Executors, hereinafter named, shall pay all my just debts from the proceeds of my Estate as soon after my death as convenient.


Item 1st: I give to my beloved wife Mary Gilliam my home Tract of land on which I now live and the following named negroes, Isaac, Ben, Milly, Delbert and Jinny, all my household and kitchen furniture, one Barouch, one ox cart, and as much of my stock of all kinds and plantation tools as she may deem sufficient for her during her natural life.


Item 2nd: I give to my son Isham Gilliam my Tract of land on Duckers Creek containing above three hundred acres and one negroe boy Stephen, and my Smith's tools, and one thousand dollars which I have advanced to him, neverless (he is to pay back into my estate three hundred dollars at the last division of my Estate) the balance to have and to hold to him and his heirs forever.


Item 3d: I give to my daughter Adline one negro woman Caroline and one thousand dollars which I have advanced to her, and eighteen hundred dollars to be paid out of my estate, as to my other children.


Item 4th: I will that all property heretobefore advanced by me to my sons John C. Gilliam, Spencer Gilliam, Clayton Gilliam, and my daughters Judith, Martha, Nancy, Mary, Sally, and Ardena be now confirmed to them forever.


Item 5th: I will that all my property belonging to my estate and not otherwise disposed of be sold after my death and the money arising therefrom with all other moneys belonging to my estate be collected by Executors and that they then divide it between all my daughters that may then be living, and the children (heirs of the body) of those that are dead, the heirs to receive jointly the portion that their mother would be entitled to in the following manner, viz:


To my daughter twenty-one hundred dollars, and to the children of my daughter Martha To-wit: William, Robert and Sally Ann Davis nineteen hundred dollars, to be equally divided between them


and to the children of Nancy Routon, To-wit: Elizabeth D., three hundred dollars, and to James, William, Robert, Frederick, Mary, and Martha two hundred dollars each,


and to Spencer Gilliam as Trustee for the Benefit of Otway Hix, the son of daughter Sally, eighteen hundred dollars, which amount is to be paid to him before he arrives at the age of twenty one years, but should he die before he arrives at that age, then that sum to be equally divided between all my children, or their heirs, the heirs to receive jointly as before,


and the children of Mary McGraw, To-wit: Richard M., William E. Twenty-one hundred dollars, to be equally divided between them,


and to Spencer Gilliam as Trustee for the benefit of my daughter Ardena Hix Twenty-one hundred dollars, but should she without an heir (of her body) and she and the heir life twelve months thereafter, then the Trustee shall give her possession of her property to have and to hold to her and to her heir forever, Richard, Harriet, and Ann Eliza nine hundred dollars to be equally divided between them.


Should there be not enough money arising from the first sale of my property to pay those several amounts, then each legatee shall receive proportionately.


I will that after the death of my wife, my home Tract of land, negroe slaves, and all property left to her, together with any and all property belonging to my estate, to sold by my Executors upon such time as they may deem best, and after they shall have collected the money arising therefrom, they then pay over so much as will make the above amount to each legatee, and should there then be a balance that shall be equally divided between all my children or their heirs as before.


And Lastly, I nominate and appoint my sons Spencer Gilliam and Isham Gilliam my Executors to this my last will and testament, and request that they not be required to give security. In Testimony Whereof, I have hereunto set my hand and affixed my seal this the 18th day of January, on thousand eight hundred and fifty five (1855), signed, sealed and delivered.
