Philander Colby moved from Vermont as a boy to Tioga County, NY, thence to Kent County, Ontario, thence to Butler County Iowa, where he died Sept. 26, 1895. His heirs filed a claim against the estate and against Philander's second wife, claiming that they had never received anything when their mother Rachel (Ferguson) Colby died in 1890. The following copy of their claim is in the loose estate papers of Philander Colby in Allington, Iowa:

You are hereby notified that the above named plaintiffs and claimants have filed their claim in the District Court of Butler County, Iowa, for Sixteen Hundred Dollars (1600) with interest at Six Per cent per annum from September 25, 1891, against the Estate of Philander Colby, duceased, and against you as Executrix of said estate.

A copy of said claim is hereto attached and is made a part of this notice.

You are further notified that said claim will come on for hearing before the said District Court of Butler County at its October 1896 Term, to be begun and held at Allison, Iowa, October 12th, 1896.

You will appear and answer on or before noon of the 2nd day of the said October Term of said court; otherwise, your default will be entered, and said hearing will be had and claim allowed as averred on the afternoon of said 2nd day of said term

CLAIM AGAINST THE ESTATE.

The above named, Experience Harrison, Charlotte Miller, William Colby, Vina Bailey, Osborne Colby, Jane Blair, Ida May Reeder, William Colby, Lorenzo Colby, Catherine Colby-Louk, as guardian of William and Lorenzo Colby last named, claim of the estate of Philander Colby and of the Executrix of said estate, Mary C. Colby, the sum of $1600, and as grounds for said claim, state the following facts:

That the above claimants are the only heirs at law of one Rachel Colby who dled on the _____ day of September, 1890.

That at the time of her death, the said Rachel Colby was the owner of a certain note and mortgage for $1200 which was owing to her from one James Bailey.

That said note and mortgage was drawn payable to Philander Colby.

That no administration was ever had on the estate of Rachel Colby.

That on or abut the 25th day of September, 1891, the said Philander Colby collected said note and mortgage amounting to $1296, and he forever retained said moneys in his own possession; and that said moneys in truth belonged to said claimants as heirs of said Rachel Colby, but they never received any part thereof, either directly or indirectly, nor did the said Philander Colby ever account for said moneys in any.manner.

That on or about the said 25th day of September, and on diverse dates thereafter, the said Philander Colby did collect other sums of money belonging to the estate of the said Rachel Colby and to these claimants as heirs of said Rachel Colby amounting to $400, which said sums these claimants cannot more particularly specify.

That the said Philander Colby has since retained all of said moneys and has never accounted for same to said claimants.

Wherefore, these claimants claim from the exeoutrix of the estate of Philander Colby the sum of Sixteen (1600) Hundred Dollars with interest thereon at Six Per cent per annum from September 25, 1891.

These claimants say further that Experience Harrison, Charlotte Miller and Jane Blair are the daughters of said Rachel Colby, deceased, and that William Colby is a son of said Rachel Colby, deceased; that Vina Bailey and Osborne Colby are the only children of one Fred Colby, deceased, who was a son of said Rachel Colby, deceased; that Ida May Reeder is the only child and daughter of one Mary Colby, deceased, who was a daughter of the said Rachel Colby; that William and Lorenzo Colby are the minor children of one Cyrus Colby, deceased, who was a son of Rachel Colby, deceased; that Mrs. Catherine Colby-Louk is the mother and guardian of said minor children, William and Lorenzo.

That the interests of the claimants are undivided, and they join in this claim.

In Fountain, he may have had a confectionary buisness including the selling of meat and oysters. He bought 2 lots on S. Main St. around 1871 and may have bought the Wright House hotel about the same time. He did buy the hotel from Wright and "....as soon as spring came and paint would dry, our name Colby was painted on in place of Wright...." He lived at Fountain, Fillmore, MN, untill Aug 1895 when he moved to Wells at the home of Eugene and Miranda (Daughter) Siddall. He was bed-ridden for two years and five months. BIO: This family lived at Holden's Plantation, Moose River, Me. from at least 1850 (Probably from 1846) untill 1865, when they moved to Casnovia, Michigan. In 1872 they left Michigan and moved to Arborville Township, York Co., Nebraska, where they homesteaded. No death certificate for Mary Ann could be found by the Nebraska Historical Society, but York County's Lincoln Creek Cemetery shows her as dying 31 October 1872, buried with Philander. Also in that cemetery are Matylon, Hannah and Orin.

Philander married Mrs. Mary Ann Ramsey Barber in April, 1877. The 1900 census shows widow Mary Ann Colby, born in England, living with her only child, Amanda Helmstead and husband George Helmstead. An 1885 stste census shows Philander, Mary A. and daughter Christina Colby, 17.

Philander's homestead records show that Philander pre-empted a homestead at Range 4W, Township 12N, Section 24, E1/2 of the SE1/4 (Homestead application No. 15244) in York County, Nebraska. The Pre-emption was filed July 30, 1872, "alleging settlement the 10th of July 1872". The following improvements were listed, at a value of $800.00: frame house 22X25 ft, stable, grainery, well, 4 acres of forest trees, and 160 rods of hedge. The house was built in July 1872 during which time Philander states that he lived in a tent. The Homestead proof was witnessed by Matylon Colby and David H. Verplank. Ownership was finalized on September 18. 1879, upon payment of $14.00. Mary Ann died 3 months after the house was finished.

Dear Uncle, I sit down to day to answer your kind letter. We are all well as this leaves us. Hoping this will find you and family enjoying the same blessing. I have not mutch news to write. The wish you exprest to have the record of my family I drawn it off from the record in my bible and is correct which you will find on the accompanying sheat. Now I will ask a small favor of you that is to look and see what condition the graves are in of my two children, and if they want filling or rounding up, do it and oblige a distant friend for it may be that I shall not see them again for life is so uncertain but I intend to visit Maine once more.

Now I will speak of the grasshoppers and the present crop. The hoppers destroyed the corn crop last season and laid their eggs in the ground in sufficient numbers to devour every vestige of green vegetation in the entire west, but having a wet cold spring the eggs rotted in some degree and the birds picked up what hatched out, so they have done us no harm this summer, but we have a prospect of a good crop. The winter rye is allready cut and in the shock so is the barley and wheat will be fit to cut by the 23rd of July. I have 55 acres of wheat, 21 of corn, 10 of oats. The wheat and oat as I walk through them reach to my shoulders and corn is above my head. Now uncle, I do not say this to brag, far from it, I do it to show you how things grow in Nebraska compared with that gravely plain that I so long tried to make a living on. But fools are not all dead yet, so let them work on. I want you to send me 4 lbs of the potato oats this fall. The amount you can send by mail so I can try them hear and I will send you some wheat known hear as grass wheat. It can be sown as fall or spring wheat ut sow it hear in the spring and it ripens the last of July and is a great yielder. Now I would ask if their can be anything realized out of the Mich. place or what condition it stands in in regard to the tax that has accumulated on it. I send you a paper printed in the county. It will give you some idea how the west has grown. I have filled the page and must quit. Give my love to all. Tell Jonas (Holden) I will write to him after harvest. P. M. Colby

OBITUARY: York (Nebraska) Republican

Died, at the residence of Loren DONALDSON, Monday morning, December 11th, at 6 o'clock, PHILANDER COLBY, aged 75 years. He was born in Maine, moved from there to Michigan, and in 1871 moved to York county, where he settled on the east half of the southeast quarter of section 24, in Arborville township. A few years after he came to this county he lost his wofe, which left him with a large family of girls and boys, having since made his home with them. Three boys and four girls survive him. The boys are T. Colby, of Brandshaw, George, of Arborville; Ambrose, of Benedict, and the girls, Mrs. Maloney, Mrs. Switzer, and Mrs. Loren Donaldson, of Benedict; Mrs. John Mayo, of Shawnee, Kans. The funeral was held Tuesday from the house, and the remains were interred at the Eberhart cemetery.

Philbrook COLBY was born on 16 MAR 1735 in Amesbury, Essex County, Massachusetts. He was baptized on 3 AUG 1735 in Amesbury, Essex County, Massachusetts. He died after 1791 at Weare, Hillsborough County, New Hampshire. He was a blacksmith.
His wife Susanna was admitted to the First Church in Haverhill, 2 August 1768. Philbrook Colby of Haverhill served under Captain Samuel Gerrish of Newbury in the French War, from 15 September 1755 to 17 December 1755. His name appears on the muster roll of men raised in 1756 for the expedition to Crown Point in Colonel Saltonstall's regiment, 14 April 1756, and on a return of Captain James Richardson's Company on 5 May 1756. Also as "blacksmith" on the muster roll of Captain Timothy Perkins's company at Ford Edward, 26 July 1756, and again on the muster roll of Captain Samuel George's company from 15 March 1757 to 5 December 1757. Philbrook Colby of Haverhill also served as private in Captain Daniel Hill's company, Colonel Samuel Johnson's regiment, which marched to Cambridge on the Alarm of 19 April 1775, four days service.
Philbrook Colby and his family moved from Haverhill, Massachusetts, to Weare, New Hampshire, after he had served two enlistments in the Revolutionary War.

He was one of the selectman fron 1819 to 1824, was representative to the general court in 1830. In 1820 he built a saw mill at the lower bog on Parsonage Meadow brook, where the mill now stands, afterwards owned by his son Hiram. He was a man of integrity, and very decided in his political preferances, and, it is said, when he got his New Hampshire Patriot, he would read it throughly before leaving it.

Comment 2: He died ae. 81 ys, 10 ms, and is buried in the Evans cemetery on White Rock Hill Road in Bow, NH. He built a saw mill about 1820 at Bow Bog on Parsonage Meadow Brook, now called Horse Brook. It was later owned for a short time by his son Hiram. He worked as a farmer and lived in the homestead at the northeast corner of Wood Hill Road and Woodhill-Hooksett Road. Philip, a Democrat, was Selectman from 1818 - 1821, 1824, 1831 - 1833, and 1837, and was a legislator in 1829.

Philip went to Portland, Maine, as a merchant’s clerk, in 1800, and was for 8 years established in mercantile pursuits in Hallowell. He had received a justice’s commission from Gov. Strong of Massachusetts in 1806, and was selectman, assessor, and school agent in Hallowell, but becoming and (heir of the grace of life,) he was admitted to Rev. Ephraim Gillett’s church, with his wife and two children, all in the mother’s sick-room, July, 1810. With his family reduced to himself and one motherless child, he gave up business; studied for the ministry nearly four years with Rev. Dr. Worcester, of Salem, Massachusetts, with a short academic course in Gilmanton, and was dismissed from the care of the Hallowell Church, and recommended and received into the 3d Congregational Church in Middleborough, Massachusetts, of which the same day he was ordained pastor, Jan 1 1817. he received an honorary M.A. from Brown University the same year, and, during the thirty-four years of his pastorate, sat in council for his church 38 times, solemnized 159 marriages, and attended the funerals of 404 deaths in his parish. One hundred and seventy-eight were added to the church, mostly as the fruits of special revival interest. Philip still being "the esteemed and useful pastor of the Congregational Church, enjoying the full confidence and affection of his people to the last. He was affable and kind, cherishing self-respect without ostentation or moroseness, combining dignity with simplicity of character, firmness with urbanity. He loved his people for their sake and for Christ’s sake. His piety sustained him to the last. His precepts and example will ever live in sweet remembrance, and, though dead, through them he speaketh still."
